11  The Committee on Commerce (Oelrich) recommended the following
12  amendment:

14         Senate Amendment 
15         On page 1, line 15, through
16            page 2, line 3, delete those lines
17  
18  and insert:  
19         (1)(a)  A person may not use the name, portrait,
20  photograph, or other image of a member of the armed forces for
21  the purpose of trade or for any commercial or advertising
22  purpose, except as provided in paragraph (b).
23         (b)  A person may use the name, portrait, photograph,
24  or other image of a member of the armed forces if the person
25  obtains the prior consent of the member of the armed forces
26  or, if the member is deceased, the prior consent of the
27  surviving spouse, personal representative, or closest living
28  relative by blood or marriage of the deceased.
29         (2)  As used in this section, the term "member of the
30  armed forces" means an officer or enlisted member of the Army,
31  Navy, Air Force, Marine Corps, or Coast Guard of the United
