An act relating to implanted microchips; prohibiting the

implanting of a microchip or similar monitoring device

into a person without providing full disclosure regarding

5

the device and obtaining the person's informed written

6

consent; providing a penalty; providing an effective date.

Be It Enacted by the Legislature of the State of Florida:

     Section 1. It is a felony of the third degree, punishable

11

as provided in s. 775.082, s. 775.083, or s. 775.084, Florida

12

Statutes, to knowingly implant a microchip or similar monitoring

13

device into a person without providing full disclosure to that

14

person regarding the use of the device and obtaining the person's

15

informed written consent.

     Section 2.  This act shall take effect July 1, 2008.
