A bill to be entitled
2An act relating to the energy-efficient appliance rebate
3program; creating s. 377.807, F.S.; authorizing the
4Florida Energy and Climate Commission to develop and
5administer a consumer rebate program for specified energy-
6efficient appliances; authorizing the commission to adopt
7rules; authorizing the commission to enter into contracts
8or memoranda of agreement with other agencies of the
9state, public-private partnerships, and other arrangements
10for specified purposes; providing an appropriation;
11providing requirements for the release of the
12appropriation; providing an effective date.

14Be It Enacted by the Legislature of the State of Florida:

16     Section 1.  Section 377.807, Florida Statutes, is created
17to read:
18     377.807  Energy-efficient appliance rebate program.--
19     (1)  The Florida Energy and Climate Commission is
20authorized to develop and administer a consumer rebate program
21for residential energy-efficient appliances, consistent with 42
22U.S.C. s. 15821 and any federal agency guidance or regulations
23issued in furtherance of federal law.
24     (2)  The commission may adopt rules pursuant to ss.
25120.536(1) and 120.54 designating eligible appliances, rebate
26amounts, and the administration of the issuance of rebates. The
27rules shall be consistent with 42 U.S.C. s. 15821 and any
28subsequent implementing federal regulations or guidance.
29     (3)  The commission is authorized to enter into contracts
30or memoranda of agreement with other agencies of the state,
31public-private partnerships, or other arrangements such that the
32most efficient means of administering consumer rebates can be
33achieved.
34     Section 2.  For the 2009-2010 fiscal year, the sum of
35$150,000 is appropriated from the General Revenue Fund to the
36Florida Energy and Climate Commission for the purpose of
37administering the energy-efficient appliance rebate program;
38however, the funds shall not be released to the commission until
39it has submitted a report to the Legislative Budget Commission
40certifying that the energy-efficient appliance rebate program
41complies with 42 U.S.C. s. 15821 and any subsequent implementing
42federal regulations and that the state will receive funds
43pursuant to 42 U.S.C. s. 15821 and the American Recovery and
44Reinvestment Act of 2009 to implement the energy-efficient
45appliance rebate program.
46     Section 3.  This act shall take effect July 1, 2009.
