3     Amendment (with title amendment)
4     Between lines 442 and 443, insert:
5     Section 4.  Section 381.0203, Florida Statutes, is amended
6to read:
7     381.0203  Pharmacy services.--
8     (1)  The department may contract on a statewide basis for
9the purchase of drugs, as defined in s. 499.003, for utilization
10to be used by state agencies and political subdivisions, and may
11adopt rules to administer this section.
12     (2)  The department may establish and maintain a pharmacy
13services program that includes, including, but is not limited
14to:
15     (a)  A central pharmacy to support pharmaceutical services
16provided by the county health departments, including
17pharmaceutical repackaging, dispensing, and the purchase and
18distribution of immunizations and other pharmaceuticals.
19     (b)  Regulation of drugs, cosmetics, and household products
20pursuant to chapter 499.
21     (c)  Consultation to county health departments as required
22by s. 154.04(1)(c).
23     (d)  A contraception distribution program which shall be
24implemented, to the extent resources permit, through the
25licensed pharmacies of county health departments. A woman who is
26eligible for participation in the contraceptive distribution
27program is deemed a patient of the county health department.
28     1.  To be eligible for participation in the program a woman
29must:
30     a.  Be a client of the department or the Department of
31Children and Family Services.
32     b.  Be of childbearing age with undesired fertility.
33     c.  Have an income between 150 and 200 percent of the
34federal poverty level.
35     d.  Have no Medicaid benefits or applicable health
36insurance benefits.
37     e.  Have had a medical examination by a licensed health
38care provider within the past 6 months.
39     f.  Have a valid prescription for contraceptives that are
40available through the contraceptive distribution program.
41     g.  Consent to the release of necessary medical information
42to the county health department.
43     2.  Fees charged for the contraceptives under the program
44must cover the cost of purchasing and providing contraceptives
45to women participating in the program.
46     3.  The department may adopt rules to administer this
47program.
