A bill to be entitled
2An act relating to state university presidents; amending
3ss. 1001.706 and 1001.74, F.S.; revising powers and duties
4of the Board of Governors and university boards of
5trustees relating to personnel; providing that a state
6university president is not subject to the personnel
7program established by the Board of Governors; requiring
8that a board of trustees appoint the university president
9and establish and administer a personnel program for the
10president; providing an effective date.

12Be It Enacted by the Legislature of the State of Florida:
13
14     Section 1.  Paragraph (a) of subsection (5) of section
151001.706, Florida Statutes, is amended to read:
16     1001.706  Powers and duties of the Board of Governors.--
17     (5)  POWERS AND DUTIES RELATING TO PERSONNEL.--
18     (a)  The Board of Governors, or the board's designee, shall
19establish the personnel program for all employees of a state
20university except, including the president.
21     Section 2.  Subsection (5) of section 1001.74, Florida
22Statutes, is amended to read:
23     1001.74  Powers and duties of university boards of
24trustees.--
25     (5)  POWERS AND DUTIES RELATING TO PERSONNEL.--
26     (a)  To the extent delegated by the Board of Governors
27pursuant to s. 1001.706, each board of trustees shall establish
28the personnel program for all employees of the university
29except, including the president.
30     (b)  Each board of trustees shall appoint a university
31president and establish and administer a personnel program for
32the president.
33     (c)(b)  The Department of Management Services shall retain
34authority over state university employees for programs
35established in ss. 110.123, 110.1232, 110.1234, 110.1238, and
36110.161 and in chapters 121, 122, and 238. Unless specifically
37authorized by law, neither the Board of Governors nor a state
38university may offer group insurance programs for employees as a
39substitute for or as an alternative to the health insurance
40programs offered pursuant to chapter 110.
41     (d)(c)  Except as otherwise provided by law, university
42employees are public employees for purposes of chapter 112 and
43the payment for travel and per diem shall not exceed the level
44specified in s. 112.061.
45     Section 3.  This act shall take effect July 1, 2009.
