A bill to be entitled
2An act relating to the pollutant discharge prevention and
3removal; amending s. 376.011, F.S.; clarifying a
4reference; repealing s. 376.17, F.S., relating to reports
5to the Legislature, to eliminate a requirement that the
6Department of Environmental Protection include in its
7recommendations to each regular session of the Legislature
8specific recommendations relating to the operation of the
9Pollutant Discharge Prevention and Control Act; amending
10s. 376.30713, F.S.; removing obsolete language requiring
11the Department of Environmental Protection to submit a
12report relating to preapproved advanced cleanup of
13petroleum contamination sites to the Governor and the
14Legislature; providing an effective date.

16Be It Enacted by the Legislature of the State of Florida:

18     Section 1.  Section 376.011, Florida Statutes, is amended
19to read:
20     376.011  Pollutant Discharge Prevention and Control Act;
21short title.-Sections 376.011-376.21 376.011-376.17, 376.19-
22376.21 shall be known as the "Pollutant Discharge Prevention and
23Control Act."
24     Section 2.  Section 376.17, Florida Statutes, is repealed.
25     Section 3.  Subsection (6) of section 376.30713, Florida
26Statutes, is renumbered as subsection (5), and present
27subsection (5) of that section is amended to read:
28     376.30713  Preapproved advanced cleanup.-
29     (5)  By December 31, 1998, the department shall submit a
30report to the Governor, the President of the Senate, and the
31Speaker of the House of Representatives on the progress and
32level of activity under the provisions of this section. The
33report shall include the following information:
34     (a)  A list of sites under a preapproved advanced cleanup
35contract, to be identified by the facility number.
36     (b)  The total number of preapproved advanced cleanup
37applications submitted to the department.
38     (c)  The priority ranking scores of each participating
39site.
40     (d)  The total amount of contract work authorized and
41conducted for each site and the percentage and amount of cost
42share.
43     (e)  The total revenues received under the provisions of
44this section.
45     (f)  The annual costs of administering the provisions of
46this section.
47     (g)  The recommended annual budget for the provisions of
48this section.
49     Section 4.  This act shall take effect July 1, 2010.
