A bill to be entitled
2An act relating to design professionals; creating ss.
3471.046, 472.0367, 481.23, and 481.333, F.S.; providing
4that the malpractice or negligence for which licensed
5engineers, surveyors and mappers, architects, interior
6designers, and registered landscape architects are liable
7must cause personal injury or damage to property other
8than the property that is the subject of the professional
9services; providing an effective date.

11Be It Enacted by the Legislature of the State of Florida:
12
13     Section 1.  Section 471.046, Florida Statutes, is created
14to read:
15     471.046  Limitation of causes of action.-Notwithstanding
16any other law, a person does not have a cause of action against
17a licensee under this chapter for the recovery of economic
18damages that result from malpractice or negligence in the
19performance of professional services if the malpractice or
20negligence does not cause personal injury or damage to property
21other than the property that is the subject of the professional
22services and the licensee performs the professional services
23pursuant to a contract between the licensee or his or her
24employer and either of the following persons:
25     (1)  The person claiming economic damages; or
26     (2)  A consultant, subconsultant, or sub-subconsultant to a
27person or entity having a contract with the person claiming
28economic damages to provide the professional services at issue.
29     Section 2.  Section 472.0367, Florida Statutes, is created
30to read:
31     472.0367  Limitation of causes of action.-Notwithstanding
32any other law, a person does not have a cause of action against
33a licensee under this chapter for the recovery of economic
34damages that result from malpractice or negligence in the
35performance of professional services if the malpractice or
36negligence does not cause personal injury or damage to property
37other than the property that is the subject of the professional

64any other law, a person does not have a cause of action against
65a licensee under this part for the recovery of economic damages
66that result from malpractice or negligence in the performance of
67professional services if the malpractice or negligence does not
68cause personal injury or damage to property other than the
69property that is the subject of the professional services and
70the licensee performs the professional services pursuant to a
71contract between the licensee or his or her employer and either
72of the following persons:
73     (1)  The person claiming economic damages; or
74     (2)  A consultant, subconsultant, or sub-subconsultant to a
75person or entity having a contract with the person claiming
76economic damages to provide the professional services at issue.
77     Section 5.  This act shall take effect upon becoming a law.
