House Joint Resolution
2A joint resolution proposing the creation of Section 22 of
3Article III of the State Constitution to require the
4Legislature by general law to adopt rules governing time
5limits, procedures, and processes relating to all death
6penalty cases and related proceedings in all courts.

8Be It Resolved by the Legislature of the State of Florida:

10     That the following creation of Section 22 of Article III of
11the State Constitution is agreed to and shall be submitted to
12the electors of this state for approval or rejection at the next
13general election or at an earlier special election specifically
14authorized by law for that purpose:

LEGISLATURE
17     SECTION 22.  Death penalty.-Notwithstanding any other
18provision of this constitution, the Legislature by general law
19shall adopt rules governing time limits, procedures, and
20processes relating to all death penalty cases and related
21proceedings in all courts.
22     BE IT FURTHER RESOLVED that the following statement be
23placed on the ballot:

26     DEATH PENALTY CASES.-The State Constitution currently
27provides that the Florida Supreme Court adopts rules for
28practice and procedure for all state courts in all cases.
29Proposing an amendment to the State Constitution to require the
30Legislature by general law to adopt rules governing time limits,
31procedures, and processes relating to all death penalty cases
32and related proceedings in all courts.
