       Senator Simmons moved the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Delete lines 73 - 77
    4  and insert:
    5  received by a claimant in an accident were enhanced by a
    6  defective product, the trier of fact shall consider the fault of
    7  all persons who contributed to the accident when apportioning
    8  fault between or among them. The jury shall be appropriately
    9  instructed by the trial judge on the apportionment of fault in
   10  products liability actions where there are allegations that the
   11  injuries received by the claimant in an accident were enhanced
   12  by a defective product. The rules of evidence apply to these
   13  actions.

   17         And the title is amended as follows:
   18         Delete lines 7 - 8
   19  and insert:
   20         in a products liability action alleging an enhanced
   21         injury; requiring the jury instructions to apportion
   22         certain fault in a products liability action;
   23         providing the rules of evidence apply; providing
   24         legislative intent to
