       The Committee on Health Regulation (Bennett) recommended the
       following:
       
    1         Senate Substitute for Amendment (788614) (with title

    5  and insert:
    6         Section 6. Section 318.121, Florida Statutes, is amended to
    7  read
    8         318.121 Preemption of additional fees, fines, surcharges,
    9  and costs.—Notwithstanding any general or special law, or
   10  municipal or county ordinance, additional fees, fines,
   11  surcharges, or costs other than the additional fees, fines,
   12  court costs and surcharges assessed under s. 318.18(11), (13),
   13  (18), and (19), and (22) may not be added to the civil traffic
   14  penalties assessed in this chapter.
   15         Section 7. Subsection (22) is added to section 318.18,
   16  Florida Statutes, to read:
   17         318.18 Amount of penalties.—The penalties required for a
   18  noncriminal disposition pursuant to s. 318.14 or a criminal
   19  offense listed in s. 318.17 are as follows:
   20         (22) In addition to any penalties or points imposed under
   21  subsection s. 316.1923, a person convicted of aggressive
   22  careless driving shall also pay:
   23         (a) Upon a first violation, a fine of $100.
   24         (b) Upon a second or subsequent conviction, a fine of not
   25  less than $250 but not more than $500 and be subject to a
   26  mandatory hearing under s. 318.19.

   28  The clerk of the court shall remit the moneys collected from the
   29  increased fine imposed by this subsection to the Department of
   30  Revenue for deposit into the Department of Health Administrative
   31  Trust Fund. Of the funds deposited into the Department of Health
   32  Administrative Trust Fund, $200,000 in the first year after this
   33  act takes effect, and $50,000 in the second and third years,
   34  shall be transferred into the Highway Safety Operating Trust
   35  Fund to offset the cost of providing educational materials
   36  related to this act. Funds deposited into the Department of
   37  Health Administrative Trust Fund under this subsection shall be
   38  allocated as follows:
   39         1. Twenty-five percent shall be allocated equally among all
   40  Level I, Level II, and pediatric trauma centers in recognition
   41  of readiness costs for maintaining trauma services.
   42         2. Twenty-five percent shall be allocated among Level I,
   43  Level II, and pediatric trauma centers based on each center’s
   44  relative volume of trauma cases as reported in the Department of
   45  Health Trauma Registry.
   46         3. Twenty-five percent shall be transferred to the
   47  Emergency Medical Services Trust Fund and used by the department
   48  for making matching grants to emergency medical services
   49  organizations as defined in s. 401.107.
   50         4. Twenty-five percent shall be transferred to the
   51  Emergency Medical Services Trust Fund and made available to
   52  rural emergency medical services as defined in s. 401.107, and
   53  shall be used solely to improve and expand prehospital emergency
   54  medical services in this state. Additionally, these moneys may
   55  be used for the improvement, expansion, or continuation of
   56  services provided.
