       Senator Garcia moved the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Delete lines 385 - 400
    4  and insert:
    5         (4) The Legislature is cognizant of the changing trends and
    6  techniques for the delivery of health care in this state and the
    7  discretion that is inherent in the diagnosis, care, and
    8  treatment of patients by different health care providers. The
    9  failure of a health care provider to order, perform, or
   10  administer supplemental diagnostic tests is shall not be
   11  actionable if the health care provider acted in good faith and
   12  with due regard for the prevailing professional standard of
   13  care.
