    1                        A bill to be entitled                      
    2         An act relating to local government code enforcement
    3         boards; amending s. 162.05, F.S.; allowing a local
    4         government code enforcement board to adopt
    5         requirements that are in lieu of residency standards
    6         for members of the board; providing criteria;
    7         providing an effective date.

    9  Be It Enacted by the Legislature of the State of Florida:
   10  
   11         Section 1. Subsection (2) of section 162.05, Florida
   12  Statutes, is amended to read:
   13         162.05 Local government code enforcement boards;
   14  organization.—
   15         (2) Members of the enforcement boards must shall be
   16  residents of the municipality, or in lieu of residency, must
   17  meet the requirements adopted by that municipality, in the case
   18  of municipal enforcement boards, or must be residents of the
   19  county, or in lieu of residency, must meet the requirements
   20  adopted by that county in the case of county enforcement boards.
   21  The requirements in lieu of residency may include persons who
   22  own a business or real property or who work for a business
   23  within the boundaries of the municipality or county.
   24  Appointments shall be made in accordance with applicable law and
   25  ordinances on the basis of experience or interest in the subject
   26  matter jurisdiction of the respective code enforcement board, in
   27  the sole discretion of the local governing body. The membership
   28  of each enforcement board shall, whenever possible, include an
   29  architect, a businessperson, an engineer, a general contractor,
   30  a subcontractor, and a realtor.
   31         Section 2. This act shall take effect July 1, 2011.
