A bill to be entitled
2An act relating to elected officials; requiring the
3Commission on Ethics and the Elections Commission to
4notify the Chief Financial Officer or the governing body
5of a county, municipality, or special district, as
6appropriate, of any fines owed to it by a person who has
7been elected to a state, county, municipal, or special
8district office; requiring the Chief Financial Officer or
9the governing body of a county, municipality, or special
10district, as appropriate, to withhold salary payments it
11would otherwise make to an elected officeholder when that
12official owes a fine to the Commission on Ethics or the
13Elections Commission; authorizing the Chief Financial
14Officer and governing bodies to retain a portion of the
15payment to cover their administrative costs; providing an
16effective date.

18Be It Enacted by the Legislature of the State of Florida:

20     Section 1.  Payment of unpaid fines by elected officials.-
21     (1)  The Commission on Ethics and the Elections Commission
22shall notify the Chief Financial Officer or the governing body
23of a county, municipality, or special district, as appropriate,
24of any fines owed to the Commission on Ethics or the Elections
25Commission by a person who has been elected to a state, county,
26municipal, or special district office.
27     (2)  The Chief Financial Officer or the governing body of a
28county, municipality, or special district, as appropriate, shall
29withhold any salary payments, less applicable state and federal
30taxes, which it would otherwise pay to a person elected to a
31state, county, municipal, or special district office when that
32person owes a fine to the Commission on Ethics or to the
33Elections Commission. The salary payments withheld shall be
34remitted to the commission that is owed the fine until the fine
35is satisfied.
36     (3)  The Chief Financial Officer or the governing body of a
37county, municipality, or special district may retain up to 2
38percent of each payment made pursuant to this section to cover
39its administrative costs.
40     Section 2.  This act shall take effect July 1, 2011.
