3     Amendment (with title amendment)
4     Remove lines 2303-2346 and insert:
5     103.095  Minor political parties.-
6     (1)  Any group of citizens organized for the general
7purposes of electing to office qualified persons and determining
8public issues under the democratic processes of the United
9States may become a minor political party of this state by
10filing with the department a certificate showing the name of the
11organization, the names and addresses of its current officers,
12including the members of its executive committee, accompanied by
13a completed uniform statewide voter registration application as
14specified in s. 97.052 for each of its current officers and
15members of its executive committee which reflect their
16affiliation with the proposed minor political party, and a copy
17of its constitution, bylaws, and rules and regulations.
18     (2)  All electors registered to vote in the minor political
19party in which he or she has so designated has a fundamental
20right to fully and meaningfully participate in the business and
21affairs of the minor political party without any monetary
22encumbrance. The constitution, bylaws, rules, regulations, or
23other equivalent documents must reflect this fundamental right
24and must provide for and contain reasonable provisions which at
25a minimum must prescribe procedures to: prescribe its
26membership, conduct its meetings according to generally accepted
27parliamentary practices, timely notify its members as to the
28time, date, and place of all of its meetings, timely publish
29notice on its public and functioning website as to the time,
30date, and place of all of its meetings, elect its officers,
31remove its officers, make party nominations when required by
32law, conduct campaigns for party nominees, raise and expend
33party funds, select delegates to its national convention, select
34presidential electors, and alter or amend all of its governing
35documents.
36     (3)  The members of the executive committee must elect a
37chair, vice chair, secretary, and treasurer, all of whom shall
38be members of the minor political party and no member may hold
39more than one office, except that one person may hold the
40offices of secretary and treasurer.
41     (4)  Upon approval of the minor political party's filing,
42the department shall process the voter registration applications
43submitted by the minor political party's officers and members of
44its executive committee. It shall be the duty of the minor
45political party to notify the department of any changes in the
46filing certificate within 5 days after such changes.
47     (5)  The Division of Elections shall adopt rules to
48prescribe the manner in which political parties, including minor
49political parties, may have their filings with the Department of
50State canceled. Such rules shall, at a minimum, provide for:
51     (a)  Notice, which must contain the facts and conduct that
52warrant the intended action, including, but not limited to, the
53failure to have any voters registered in the party, the failure
54to notify the department of replacement officers, and the
55failure to file campaign finance reports, the failure to adopt
56or file with the department all governing documents containing
57the provisions specified in subsection (2), and limited
58activity.
59     (b)  Adequate opportunity to respond.
60     (c)  Appeal of the decision to the Florida Elections
61Commission. Such appeals are exempt from the confidentiality
62provisions of s. 106.25.
63     (6)  The requirements of this section are retroactive for
64any minor political party registered with the department on July
651, 2011, and must be complied with within 180 days after the
66department provides notice to the minor political party of the
67requirements contained in this section. Failure of the minor
68political party to comply with the requirements within 180 days
69after receipt of the notice shall automatically result in the
70cancellation of the minor political party's registration.
