3     Amendment to Amendment (167836) (with title amendment)
4     Remove lines 101-155 and insert:
5     (3)(a)  A third-party voter registration organization that
6collects voter registration applications or a political party,
7third-party organization, or campaign that collects absentee
8ballot requests or completed absentee ballots serves as a
9fiduciary to the applicant, ensuring that any voter registration
10application or absentee ballot application or absentee ballot
11entrusted to the entity third-party voter registration
12organization, irrespective of party affiliation, race,
13ethnicity, or gender, shall be promptly delivered to the
14division or the supervisor of elections within 48 hours after
15the applicant completes it or the next business day if the
16appropriate office is closed for that 48-hour period. If a voter
17registration application, absentee ballot request, or completed
18absentee ballot collected by any third-party voter registration
19organization is not promptly delivered to the division or
20supervisor of elections, the third-party voter registration
21organization, political party, third-party organization, or
22campaign is shall be liable for the following fines:
23     1.(a)  A fine in the amount of $50 for each application,
24absentee ballot request, or completed absentee ballot received
25by the division or the supervisor of elections more than 48
26hours 10 days after the applicant delivered the completed voter
27registration application, absentee ballot request, or absentee
28ballot to the third-party voter registration organization,
29political party, third-party organization, or campaign or any
30person, entity, or agent acting on its behalf, or the next
31business day, if the office is closed. A fine in the amount of
32$250 for each application, absentee ballot request, or completed
33absentee ballot received if the third-party voter registration
34organization, political party, third-party organization, or
35campaign or any registration organization or person, entity, or
36agency acting on its behalf acted willfully.
37     2.(b)  A fine in the amount of $100 for each application,
38absentee ballot request, or completed absentee ballot collected
39by a third-party voter registration organization, political
40party, third-party organization, or campaign or any person,
41entity, or agent acting on its behalf, before prior to book
42closing for any given election for federal or state office and
43received by the division or the supervisor of elections after
44the book closing deadline for such election. A fine in the
45amount of $500 for each application, absentee ballot request, or
46competed absentee ballot received if the third-party voter
47registration organization, political party, third-party
48organization, or campaign or any or person, entity, or agency
49acting on its behalf acted willfully.
50     3.(c)  A fine in the amount of $500 for each application,
51absentee ballot request, or completed absentee ballot collected
52by a third-party voter registration organization, political
53party, third-party organization, or campaign or any person,
54entity, or agent acting on its behalf, which is not submitted to
55the division or supervisor of elections. A fine in the amount of
56$1,000 for any application, absentee ballot request, or competed
57absentee ballot not submitted if the third-party registration
58organization, political party, third-party organization, or
59campaign or any or person, entity, or agency acting on its
60behalf acted willfully.

62The aggregate fine pursuant to this paragraph subsection which
63may be assessed against a third-party voter registration
64organization, including affiliate organizations, or a political
65party, third-party organization, or campaign that collects
66absentee ballot requests or completed absentee ballots for
67violations committed in a calendar year is shall be $1,000.
68     (b)  A showing by the fines provided in this subsection
69shall be reduced by three-fourths in cases in which the third-
70party voter registration organization, or the political party,
71third-party organization, or campaign that collects absentee
72ballot requests or completed absenttee ballots that the failure
73to deliver the voter registration applications or absentee
74ballot requests within the required timeframe is based upon
75force majeure or impossibility of performance is an affirmative
76defense to a violation of this subsection has complied with
77subsection (1). The secretary may shall waive the fines
78described in this subsection upon a showing that the failure to
79deliver the voter registration application promptly is based
80upon force majeure or impossibility of performance.
