       The Committee on Judiciary (Braynon) recommended the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Between lines 191 and 192
    4  insert:
    5         Section 3. Section 400.0246, Florida Statutes, is created
    6  to read:
    7         400.0246Reporting of criminal conduct on premises;
    8  destruction of evidence prohibited.—An employee or officer of a
    9  nursing home facility shall report any criminal conduct
   10  witnessed or learned of subsequent to its occurrence to a local
   11  law enforcement agency before reporting the conduct to the
   12  employer, a supervisor, or a director. Every effort must be made
   13  to preserve all evidence relating to the crime. Destruction of
   14  evidence is punishable as a third-degree felony, as provided in
   15  s. 775.082, s. 775.083, or s. 775.084.

   18         And the title is amended as follows:
   19         Delete line 18
   20  and insert:
   21         definitions; creating s. 400.0246, F.S.; requiring an
   22         employee or officer of a nursing home facility to
   23         report to a local law enforcement agency any criminal
   24         conduct in the nursing home facility; requiring
   25         preservation of evidence; specifying criminal
   26         sanctions for destruction of evidence; providing an
   27         effective date.
