       The Committee on Budget (Richter) recommended the following:

    7         Section 90. Paragraph (h) of subsection (3) of section
    8  456.053, Florida Statutes, is amended to read:
    9         456.053 Financial arrangements between referring health
   10  care providers and providers of health care services.—
   11         (3) DEFINITIONS.—For the purpose of this section, the word,
   12  phrase, or term:
   13         (h) “Group practice” means a group of two or more health
   14  care providers legally organized as a partnership, professional
   15  corporation, or similar association:
   16         1. In which each health care provider who is a member of
   17  the group provides substantially the full range of services
   18  which the health care provider routinely provides, including
   19  medical care, consultation, diagnosis, or treatment, through the
   20  joint use of shared office space, facilities, equipment, and
   21  personnel;
   22         2. For which substantially all of the services of the
   23  health care providers who are members of the group are provided
   24  through the group and are billed in the name of the group and
   25  amounts so received are treated as receipts of the group; and
   26         3. In which the overhead expenses of and the income from
   27  the practice are distributed in accordance with methods
   28  previously determined by members of the group; and.
   29         4. In which a group that provides radiation therapy
   30  services, including the full range of radiation therapy
   31  services, such that no single type of cancer, as a primary or
   32  secondary diagnosis and as described by the International
   33  Statistical Classification of Diseases, constitutes 40 percent
   34  or more of the group’s cases for professional and technical
   35  radiation therapy services, and the health care providers within
   36  the group who refer patients for radiation therapy services do
   37  not own 50 percent or more of the group practice. As used in
   38  this subparagraph, the term “case” means an individual patient’s
   39  radiation treatment course.
