3     Amendment (with title amendment)
4     Between lines 11 and 12, insert:
5     Section 1.  Section 447.18, Florida Statutes, is created to
6read:
7     447.18  Written authorization required to expend certain
8employee dues, assessments, fines, or penalties.-
9     (1)  A labor organization may not use dues, uniform
10assessments, fines, penalties, or special assessments paid by an
11employee to make contributions or expenditures, as defined in s.
12106.011, without the express written authorization of the
13employee. The written authorization must be executed by the
14employee separately for each fiscal year of the labor
15organization and shall be accompanied by a detailed account,
16provided by the labor organization, of all contributions and
17expenditures made by the labor organization in the preceding 24
18months. The labor organization shall estimate its expected
19contributions and expenditures for the fiscal year and shall
20reduce the amount collected during the fiscal year from each
21employee who has not executed a written authorization. If the
22actual contributions and expenditures of the labor organization
23exceed its estimated contributions and expenditures, the labor
24organization shall provide a refund at the end of the fiscal
25year to each employee who has not executed a written
26authorization.
27     (2)  The employee may revoke the authorization described in
28subsection (1) at any time. If an employee revokes the
29authorization, the employee is entitled to a pro rata reduction
30of such dues, uniform assessments, fines, penalties, or special
31assessments for the remainder of the fiscal year of the labor
32organization. The amount of the reduction shall be based on the
33proportion of the contributions and expenditures, as defined in
34s. 106.011, in relation to the total annual contributions and
35expenditures of the labor organization for the preceding fiscal
36year.
37     (3)  A labor organization may not require an employee to
38provide the authorization described in subsection (1) as a
39condition of membership in the labor organization.

48political contributions or expenditures without an employee's
49written authorization; providing for a refund to employees who
50have not given a written authorization in certain situations;
51requiring that the labor organization provide notice of such
52contributions and expenditures; prohibiting a labor organization
53from requiring an employee to authorize the collection of funds
54for political contributions and expenditures as a condition of
55membership in the organization; creating s. 448.111,
