       Senator Bennett moved the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Between lines 770 and 771
    4  insert:
    5         Section 18. Section 514.0315, Florida Statutes, is created
    6  to read:
    7         514.0315 Safety features for public swimming pools and
    8  spas.—
    9         (1) A public swimming pool or spa must be equipped with an
   10  anti-entrapment system or device that complies with American
   11  Society of Mechanical Engineers/American National Standards
   12  Institute standard A112.19.8, or any successor standard.
   13         (2) A public swimming pool or spa built before January 1,
   14  1993, with a single main drain other than an unblockable drain,
   15  must be equipped with at least one of the following features
   16  that complies with the American Society of Mechanical Engineers,
   17  American National Standards Institute, American Standard for
   18  Testing and Materials, or other applicable consumer product
   19  safety standard for such system or device, and protects against
   20  evisceration and body-and-limb suction entrapment:
   21         (a) A safety vacuum release system that ceases operation of
   22  the pump, reverses the circulation flow, or otherwise provides a
   23  vacuum release at a suction outlet when a blockage is detected,
   24  and that has been tested by an independent third party and found
   25  to conform to American Society of Mechanical Engineers/American
   26  National Standards Institute standard A112.19.17, American
   27  Standard for Testing and Materials standard 26 F2387, or any
   28  successor standard.
   29         (b) A suction-limiting vent system that has a tamper
   30  resistant atmospheric opening.
   31         (c) A gravity drainage system that uses a collector tank.
   32         (d) An automatic pump shut-off system.
   33         (e) A device or system that disables the drain.
   34         (3) The determination and selection of a feature under
   35  subsection (2) for a public swimming pool or spa constructed
   36  before January 1, 1993, is at the sole discretion of the owner
   37  or operator of the public swimming pool or spa. A licensed
   38  contractor described in s. 489.105(3)(j), (k), or (l) must
   39  install the feature.
