A bill to be entitled
2An act relating to assisted living facilities; amending s.
3429.14, F.S.; removing a provision that authorizes the
4Agency for Health Care Administration to deny a license to
5an applicant or controlling interest of an assisted living
6facility when the applicant or controlling interest has a
7financial or ownership interest in another licensed
8facility upon which specified sanctions have been imposed
9within a certain period of time; removing a provision that
10requires the agency to provide certain information
11relating to assisted living facility license status to the
12Division of Hotels and Restaurants of the Department of
13Business and Professional Regulation; providing an
14effective date.

16Be It Enacted by the Legislature of the State of Florida:

18     Section 1.  Subsections (4), (5), and (7) of section
19429.14, Florida Statutes, are renumbered as subsections (3),
20(4), and (5), respectively, and present subsections (3) and (6)
21of that section are amended to read:
22     429.14  Administrative penalties.-
23     (3)  The agency may deny a license to any applicant or
24controlling interest as defined in part II of chapter 408 which
25has or had a 25-percent or greater financial or ownership
26interest in any other facility licensed under this part, or in
27any entity licensed by this state or another state to provide
28health or residential care, which facility or entity during the
295 years prior to the application for a license closed due to
30financial inability to operate; had a receiver appointed or a
31license denied, suspended, or revoked; was subject to a
32moratorium; or had an injunctive proceeding initiated against
33it.
34     (6)  The agency shall provide to the Division of Hotels and
35Restaurants of the Department of Business and Professional
36Regulation, on a monthly basis, a list of those assisted living
37facilities that have had their licenses denied, suspended, or
38revoked or that are involved in an appellate proceeding pursuant
39to s. 120.60 related to the denial, suspension, or revocation of
40a license.
41     Section 2.  This act shall take effect July 1, 2011.
