A bill to be entitled
2An act relating to an environmental surcharge on bottled
3water; establishing a surcharge on bottled water sold at
4retail in this state; providing an exception; requiring
5that moneys collected from the surcharge be deposited into
6the Ecosystem Management and Restoration Trust Fund;
7providing an effective date.

9Be It Enacted by the Legislature of the State of Florida:

11     Section 1.  (1)  An environmental surcharge is imposed on
12each bottle of water sold in the amount of 6 percent of the sale
13price of each item, article, or group of items of or containing
14bottled water when sold at retail in this state. The surcharge
15does not apply to water bottled in 1 gallon containers or
16larger.
17     (2)  All moneys collected from the surcharge levied under
18this section shall be deposited into the Ecosystem Management
19and Restoration Trust Fund within the Department of
20Environmental Protection.
21     (3)  The surcharge levied under this section shall be
22administered, collected, and enforced in the same manner as the
23tax imposed under s. 212.05, Florida Statutes.
24     Section 2.  This act shall take effect October 1, 2011.
