A bill to be entitled
2An act relating to the management of funds for water
3pollution control loans and grants; amending s. 403.1835,
4F.S.; providing for the deposit of specified revenues into
5the Department of Environmental Protection's Federal
6Grants Trust Fund; requiring service fees to be used for
7specified water quality activities in addition to program
8administration; clarifying the purposes for which certain
9federal appropriations and state matching funds must be
10used; providing an effective date.

12Be It Enacted by the Legislature of the State of Florida:

14     Section 1.  Paragraph (b) of subsection (9) of section
15403.1835, Florida Statutes, is amended to read:
16     403.1835  Water pollution control financial assistance.-
17     (9)  Funds for the loans and grants authorized under this
18section must be managed as follows:
19     (b)  Revenues from the loan grant allocations authorized
20under subsection (4), federal appropriations used for the
21purpose of administering this section, state matching funds for
22grants authorized by federal statute or other federal action,
23and service fees, and all earnings thereon, shall be deposited
24into the department's Federal Grants and Donations Trust Fund.
25Service fees and all earnings thereon must be used solely for
26program administration and other water quality activities
27specifically authorized pursuant to the Federal Water Pollution
28Control Act (Clean Water Act). The loan grant allocation
29revenues and earnings thereon must be used solely for the
30purpose of making grants to financially disadvantaged small
31communities. Federal appropriations and state matching funds for
32grants authorized by federal statute or other federal action,
33and all earnings thereon, must be used solely for the purposes
34authorized under this section. All deposits into the
35department's Federal Grants and Donations Trust Fund under this
36section, and all earnings thereon, must be accounted for
37separately from all other moneys deposited into the fund.
38     Section 2.  This act shall take effect July 1, 2011.
