A bill to be entitled
2An act relating to service of process; amending s. 48.031,
3F.S.; specifying where a process server must record
4certain information concerning service; granting
5authorized process servers unannounced access to specified
6residential areas where a defendant or witness resides or
7is known to be; amending s. 48.29, F.S.; conforming
8provisions to changes made by the act; providing an
9effective date.

11Be It Enacted by the Legislature of the State of Florida:

13     Section 1.  Subsection (5) of section 48.031, Florida
14Statutes, is amended, and subsection (7) is added to that
15section, to read:
16     48.031  Service of process generally; service of witness
17subpoenas.-
18     (5)  A person serving process shall place, on the front
19page of the copy served, the date and time of service and his or
20her identification number and initials for all service of
21process.
22     (7)  A person authorized to serve process shall be granted
23unannounced access to the common areas, both general and
24limited, of condominiums, gated communities, or any secured
25residential areas where a defendant or witness resides or is
26known to be.
27     Section 2.  Subsection (6) of section 48.29, Florida
28Statutes, is amended to read:
29     48.29  Certification of process servers.-
30     (6)  A certified process server shall place the information
31provided in s. 48.031(5) on the front page of the copy served.
32Return of service shall be made by a certified process server on
33a form which has been reviewed and approved by the court.
34     Section 3.  This act shall take effect July 1, 2011.
