A bill to be entitled
2An act relating to public food service establishments;
3creating s. 509.234, F.S.; requiring public food service
4establishments to serve sugar-free substitutes for certain
5syrups and fruit preserves and provide notice to guests of
6the availability of such sugar-free substitutes; providing
7requirements for such notice; providing an effective date.

9Be It Enacted by the Legislature of the State of Florida:

11     Section 1.  Section 509.234, Florida Statutes, is created
12to read:
13     509.234  Sugar-free substitutes for syrups and fruit
14preserves; notice to guests.-A public food service establishment
15that serves pancake or waffle syrup or any jelly, jam,
16marmalade, or other fruit preserves must:
17     (1)  Serve a sugar-free substitute for such syrup or fruit
18preserves.
19     (2)  Provide notice to guests of the availability of such
20sugar-free syrup or fruit preserves. The notice must be included
21on the establishment's food menu and displayed prominently in
22any location at the establishment where any foods served with
23such syrup or fruit preserves are advertised for sale,
24including, but not limited to, the posting of daily specials, an
25overhead menu posted at a food service counter, an outdoor menu
26posted for guests using a drive-through service window, and any
27signage posted at the establishment.
28     Section 2.  This act shall take effect July 1, 2011.
