    1                        A bill to be entitled                      
    2         An act relating to trust funds; creating s. 499.0031,
    3         F.S.; creating the Florida Drug, Device, and Cosmetic
    4         Trust Fund within the Department of Business and
    5         Professional Regulation; providing for the purpose of
    6         the trust fund and sources of funds; providing for
    7         future review and termination or re-creation of the
    8         trust fund; providing an effective date.

   10  Be It Enacted by the Legislature of the State of Florida:
   11  
   12         Section 1. Section 499.0031, Florida Statutes, is created
   13  to read:
   14         499.0031 Florida Drug, Device, and Cosmetic Trust Fund.—
   15         (1) The Florida Drug, Device, and Cosmetic Trust Fund is
   16  created within the Department of Business and Professional
   17  Regulation.
   18         (2) Funds to be credited to and uses of the trust fund
   19  shall be administered in accordance with the provisions of
   20  chapter 499. Funds shall be expended only pursuant to
   21  legislative appropriation or an approved amendment to the
   22  department’s operating budget pursuant to the provisions of
   23  chapter 216, Florida Statutes.
   24         (3) In accordance with s. 19(f)(2), Article III of the
   25  State Constitution, the Florida Drug, Device, and Cosmetic Trust
   26  Fund shall, unless terminated sooner, be terminated on July 1,
   27  2015. Before its scheduled termination, the trust fund shall be
   28  reviewed as provided in s. 215.3206(1) and (2), Florida
   29  Statutes.
   30         Section 2. This act shall take effect July 1, 2011, except
   31  that this act shall not take effect unless it is enacted by a
   32  three-fifths vote of the membership of each house of the
   33  Legislature.
