3     Amendment (with title amendment)
4     Remove lines 6909-6910 and insert:
5     Section 29.  Subsections (9), (12), and (14) of section
6163.3246, Florida Statutes, are amended to read:
7     163.3246  Local government comprehensive planning
8certification program.-
9     (9)(a)  Upon certification all comprehensive plan
10amendments associated with the area certified must be adopted
11and reviewed in the manner described in s. ss. 163.3184(5)-
12(11)(1), (2), (7), (14), (15), and (16) and 163.3187, such that
13state and regional agency review is eliminated. Plan amendments
14that qualify as small scale development amendments may follow
15the small scale review process in s. 163.3187. The department
16may not issue any objections, recommendations, and comments
17report on proposed plan amendments or a notice of intent on
18adopted plan amendments; however, affected persons, as defined
19by s. 163.3184(1)(a), may file a petition for administrative
20review pursuant to the requirements of s. 163.3184(5)
21163.3187(3)(a) to challenge the compliance of an adopted plan
22amendment.
23     (b)  Plan amendments that change the boundaries of the
24certification area; propose a rural land stewardship area
25pursuant to s. 163.3248 163.3177(11)(d); propose a an optional
26sector plan pursuant to s. 163.3245; propose a school facilities
27element; update a comprehensive plan based on an evaluation and
28appraisal review report; impact lands outside the certification
29boundary; implement new statutory requirements that require
30specific comprehensive plan amendments; or increase hurricane
31evacuation times or the need for shelter capacity on lands
32within the coastal high-hazard area shall be reviewed pursuant
33to s. ss. 163.3184 and 163.3187.
34     (12)  A local government's certification shall be reviewed
35by the local government and the department as part of the
36evaluation and appraisal process pursuant to s. 163.3191. Within
371 year after the deadline for the local government to update its
38comprehensive plan based on the evaluation and appraisal report,
39the department shall renew or revoke the certification. The
40local government's failure to adopt a timely evaluation and
41appraisal report, failure to adopt an evaluation and appraisal
42report found to be sufficient, or failure to timely adopt
43necessary amendments to update its comprehensive plan based on
44an evaluation and appraisal, which are report found to be in
45compliance by the department, shall be cause for revoking the
46certification agreement. The department's decision to renew or
47revoke shall be considered agency action subject to challenge
48under s. 120.569.
49     (14)  The Office of Program Policy Analysis and Government
50Accountability shall prepare a report evaluating the
51certification program, which shall be submitted to the Governor,
52the President of the Senate, and the Speaker of the House of
53Representatives by December 1, 2007.
54     Section 30.  Section 163.32465, Florida Statutes, is
55repealed.
56     Section 31.  Subsection (6) is added to section 163.3247,
57Florida Statutes, to read:
58     163.3247  Century Commission for a Sustainable Florida.-
59     (6)  EXPIRATION.-This section is repealed and the
60commission is abolished June 30, 2013.
