    2         An act relating to emergency public shelters; creating
    3         s. 252.353, F.S.; requiring the Division of Emergency
    4         Management to submit a report to the Governor and
    5         Legislature on compliance by school districts with
    6         public shelter requirements for educational
    7         facilities; requiring that the division create and
    8         administer a registry of newly constructed public
    9         shelters; requiring each county emergency management
   10         office to submit an annual report to the division on
   11         newly constructed educational facilities; providing an
   12         effective date.

   14  Be It Enacted by the Legislature of the State of Florida:
   15  
   16         Section 1. Section 252.353, Florida Statutes, is created to
   17  read:
   18         252.353 Emergency management; public shelters.—
   19         (1)On January 31, 2012, and each year thereafter, the
   20  division shall prepare and submit to the Governor, the President
   21  of the Senate, and the Speaker of the House of Representatives a
   22  report on newly constructed educational facilities in the state
   23  and on the compliance by school districts with the
   24  infrastructure standards for public shelters developed pursuant
   25  to s. 1013.372(1). The report must provide, at a minimum:
   26         (a) A listing by county of the number of educational
   27  facilities that were constructed during the reporting year and
   28  that met or failed to meet the infrastructure standards for
   29  public shelters developed pursuant to s. 1013.372(1).
   30         (b) The composition of general population shelters and
   31  special needs shelters that were constructed for those
   32  educational facilities and that met the infrastructure standards
   33  for public shelters during the reporting year.
   34         (c) An explanation of the waiver process for each newly
   35  constructed educational facility that was granted a waiver from
   36  the infrastructure standards for public shelters during the
   37  reporting year, including an explanation of the circumstances
   38  that warranted a waiver.
   39         (d) Information on school district facilities that were
   40  retrofitted during the reporting year in order to meet the
   41  infrastructure standards for public shelters.
   42         (2) The division shall create and administer a registry
   43  that is accessible from the division’s website and that contains
   44  information on school districts’ compliance with the
   45  infrastructure standards for public shelters developed pursuant
   46  to s. 1013.372(1). The registry shall be available on the
   47  website by January 31, 2012, and must include data beginning
   48  with January 1, 2011.
   49         (3) By November 30, 2012, and each year thereafter, each
   50  county emergency management office shall prepare and submit a
   51  report to the division on educational facilities within the
   52  county which addresses the reporting requirements in subsection
   53  (1).
   54         Section 2. This act shall take effect July 1, 2011.
