    1                        A bill to be entitled                      
    2         An act relating to district school board members;
    3         amending ss. 145.19 and 1001.39, F.S.; conforming
    4         cross-references; amending s. 1001.395, F.S.; removing
    5         provisions relating to base salary and additional
    6         compensation for a district school board member;
    7         prohibiting district school board members from
    8         receiving more than a $100 stipend per school board
    9         meeting; providing that the stipend does not
   10         constitute compensation for retirement purposes;
   11         providing reimbursement for travel expenses;
   12         prohibiting district school board members from
   13         receiving any compensation while serving; providing
   14         for application; providing an effective date.

   16  Be It Enacted by the Legislature of the State of Florida:
   17  
   18         Section 1. Subsection (2) of section 145.19, Florida
   19  Statutes, is amended to read:
   20         145.19 Annual percentage increases based on increase for
   21  state career service employees; limitation.—
   22         (2) Each fiscal year, the salaries of all officials listed
   23  in this chapter, s. 1001.395, and s. 1001.47 shall be adjusted.
   24  The adjusted salary rate shall be the product, rounded to the
   25  nearest dollar, of the salary rate granted by the appropriate
   26  section of this chapter, s. 1001.395, or s. 1001.47 multiplied
   27  first by the initial factor, then by the cumulative annual
   28  factor, and finally by the annual factor. The Department of
   29  Management Services shall certify the annual factor and the
   30  cumulative annual factors. Any special qualification salary
   31  received under this chapter, s. 1001.47, or the annual
   32  performance salary incentive available to elected
   33  superintendents under s. 1001.47 shall be added to such adjusted
   34  salary rate. The special qualification salary shall be $2,000,
   35  but shall not exceed $2,000.
   36         Section 2. Section 1001.39, Florida Statutes, is amended to
   37  read:
   38         1001.39 District school board members; travel expenses.—
   39         (1) In addition to the salary provided in s. 1001.395, Each
   40  member of a district school board shall be allowed, from the
   41  district school fund, reimbursement of travel expenses as
   42  authorized in s. 112.061, except as provided in subsection (2).
   43  Any travel outside the district shall also be governed by the
   44  rules of the State Board of Education.
   45         (2) Each district school board may reimburse a district
   46  school board member for travel expenses for travel from the
   47  member’s residence incurred in the performance of a public
   48  purpose authorized by law to be performed by the district school
   49  board, including, but not limited to, attendance at regular and
   50  special board meetings. Mileage allowance in the amount provided
   51  by law for reimbursement of travel expenses, when authorized,
   52  shall be computed from the member’s place of residence to the
   53  place of the meeting or function and return.
   54         Section 3. Section 1001.395, Florida Statutes, is amended
   55  to read:
   56         1001.395 District school board members; stipend;
   57  reimbursement for travel expenses compensation.—
   58         (1)District school board members may not receive more than
   59  a $100 stipend per school board meeting, which does not
   60  constitute compensation for purposes of retirement. However,
   61  district school board members may receive reimbursement for
   62  travel expenses in accordance with s. 1001.39. District school
   63  board members shall otherwise serve without compensation. Each
   64  member of the district school board shall receive a base salary,
   65  the amounts indicated in this section, based on the population
   66  of the county the district school board member serves. In
   67  addition, compensation shall be made for population increments
   68  over the minimum for each population group, which shall be
   69  determined by multiplying the population in excess of the
   70  minimum for the group times the group rate. The product of such
   71  calculation shall be added to the base salary to determine the
   72  adjusted base salary. The adjusted base salaries of district
   73  school board members shall be increased annually as provided for
   74  in s. 145.19.

   84         (2) Notwithstanding the provisions of this section or s.
   85  145.19, district school board members may reduce their salary
   86  rate on a voluntary basis.
   87         (3) Notwithstanding the provisions of this section and s.
   88  145.19, for the 2010-2011 fiscal year, the salary of each
   89  district school board member shall be the amount calculated
   90  pursuant to subsection (1) or the district’s beginning salary
   91  for teachers who hold baccalaureate degrees, whichever is less.
   92         Section 4. The amendments made by this act to ss. 145.19,
   93  1001.39, and 1001.395, Florida Statutes, apply to district
   94  school board members elected or reelected in 2012 and
   95  thereafter.
   96         Section 5. This act shall take effect July 1, 2011.
