A bill to be entitled
2An act relating to the Division of Alcoholic Beverages and
3Tobacco of the Department of Business and Professional
4Regulation; amending s. 561.422, F.S.; revising provisions
5relating to issuance by the division of temporary permits
6to nonprofit civic organizations to sell alcoholic
7beverages; permitting the issuance of permits to any
8nonprofit organization; allowing the sale to include
9beverages for consumption on or off the premises;
10providing an effective date.

12Be It Enacted by the Legislature of the State of Florida:

14     Section 1.  Section 561.422, Florida Statutes, is amended
15to read:
16     561.422  Nonprofit civic organizations; temporary permits.-
17Upon the filing of an application, presentation of a local
18building and zoning permit, and payment of a fee of $25 per
19permit, the director of the division may issue a permit
20authorizing a bona fide nonprofit civic organization to sell
21alcoholic beverages for consumption on or off the premises only,
22for a period not to exceed 3 days, subject to any state law or
23municipal or county ordinance regulating the time for selling
24such beverages. All net profits from sales of alcoholic
25beverages collected during the permit period must be retained by
26the nonprofit civic organization. Any such civic organization
27may be issued only three such permits per calendar year.
28Notwithstanding other provisions of the Beverage Law, any civic
29organization licensed under this section may purchase alcoholic
30beverages from a distributor or vendor licensed under the
31Beverage Law.
32     Section 2.  This act shall take effect July 1, 2011.
