| 2 | An act relating to taxi operators; authorizing |
| 3 | governmental units that regulate the operation of taxis to |
| 4 | create a private property right in the license to operate |
| 5 | a taxi; providing for the transfer of such property right; |
| 6 | providing definitions; providing an effective date. |

| 8 | Be It Enacted by the Legislature of the State of Florida: |
| 9 |

| 10 | Section 1. (1) Any governmental unit that is authorized |
| 11 | to regulate the operation of taxis within its geographic |
| 12 | boundaries may adopt ordinances, rules, regulations, orders, or |
| 13 | other acts that create a private property right or interest in a |
| 14 | license to operate a taxi within the geographic boundaries of |
| 15 | the governmental unit. |
| 16 | (2) Upon the creation of such private property right, the |
| 17 | owner of a taxi operation may pledge, sell, assign, sublease, or |
| 18 | otherwise transfer the license to another person. However, the |
| 19 | owner must apply to the governmental unit before making such |
| 20 | transfer and obtain its approval for the proposed action, except |
| 21 | that a license may be transferred by operation of intestate |
| 22 | succession or devise. |
| 23 | (3) As used in this section, the term: |
| 24 | (a) "License" includes any certificate, permit, medallion, |
| 25 | or other evidence that authorizes a person to operate a taxi |
| 26 | within the geographic boundaries of a governmental unit. |
| 27 | (b) "Governmental unit" includes a county, municipality, |
| 28 | special district, commission, or other unit of state or local |
| 29 | government. |
| 30 | Section 2. This act shall take effect July 1, 2011. |
