A bill to be entitled
2An act relating to state parks; amending s. 258.0145,
3F.S.; providing for the parents of certain deceased
4veterans to receive annual entrance passes to state parks
5at no charge; amending s. 380.0685, F.S., relating to a
6surcharge imposed on admission fees to state parks in
7areas of critical state concern located in certain
8counties; providing for certain municipalities to use the
9proceeds of the surcharge for land acquisition or beach
10renourishment or restoration; providing limitations for
11purposes of determining state matching funds; exempting
12the state from specified liability provisions with respect
13to parks within the state park system that have free-
14roaming animal populations; designating Jack Mashburn
15Marina in Bay County; directing the Department of
16Environmental Protection to erect suitable markers;
17providing an effective date.

19Be It Enacted by the Legislature of the State of Florida:
20
21     Section 1.  Subsection (3) of section 258.0145, Florida
22Statutes, is amended to read:
23     258.0145  Military state park fee discounts.-The Division
24of Recreation and Parks shall provide the following discounts on
25park fees to persons who present written documentation
26satisfactory to the division which evidences their eligibility
27for the discounts:
28     (3)  Surviving spouses and parents of deceased members of
29the United States Armed Forces, National Guard, or reserve
30components thereof who have fallen in combat shall receive
31lifetime family annual entrance passes at no charge.
32     Section 2.  Section 380.0685, Florida Statutes, is amended
33to read:
34     380.0685  State park in area of critical state concern in
35county which creates land authority; surcharge on admission and
36overnight occupancy.-The Department of Environmental Protection
37shall impose and collect a surcharge of 50 cents per person per
38day, or $5 per annual family auto entrance permit, on admission
39to all state parks in areas of critical state concern located in
40a county which creates a land authority pursuant to s.
41380.0663(1), and a surcharge of $2.50 per night per campsite,
42cabin, or other overnight recreational occupancy unit in state
43parks in areas of critical state concern located in a county
44which creates a land authority pursuant to s. 380.0663(1);
45however, no surcharge shall be imposed or collected under this
46section for overnight use by nonprofit groups of organized group
47camps, primitive camping areas, or other facilities intended
48primarily for organized group use. Such surcharges shall be
49imposed within 90 days after any county creating a land
50authority notifies the Department of Environmental Protection
51that the land authority has been created. The proceeds from such
52surcharges, less a collection fee that shall be kept by the
53Department of Environmental Protection for the actual cost of
54collection, not to exceed 2 percent, shall be transmitted to the
55land authority of the county from which the revenue was
56generated. Such funds shall be used to purchase property in the
57area or areas of critical state concern in the county from which
58the revenue was generated. An amount not to exceed 10 percent
59may be used for administration and other costs incident to such
60purchases. However, the proceeds of the surcharges imposed and
61collected pursuant to this section in a state park or parks
62located wholly within a municipality, less the costs of
63collection as provided herein, shall be transmitted to that
64municipality for use by the municipality for land acquisition or
65for beach renourishment or restoration, including, but not
66limited to, costs associated with any design, permitting,
67monitoring, and mitigation of such work, as well as the work
68itself. However, these funds may not be included in any
69calculation used for providing state matching funds for local
70contributions for beach renourishment or restoration. The
71surcharges levied under this section shall remain imposed as
72long as the land authority is in existence.
73     Section 3.  The state is exempt from the provisions of s.
74588.15, Florida Statutes, with respect to any property within
75the state park system that has free-roaming animal populations.
76     Section 4.  Jack Mashburn Marina designated; Department of
77Environmental Protection to erect suitable markers.-
78     (1)  The marina commonly referred to as the "boat basin" on
79Grand Lagoon at St. Andrews State Park in Bay County is
80designated as "Jack Mashburn Marina."
81     (2)  The Department of Environmental Protection is directed
82to erect suitable markers designating Jack Mashburn Marina as
83described in subsection (1).
84     Section 5.  This act shall take effect July 1, 2011.
