3     Amendment (with title amendment)
4     Remove lines 1128-1143 and insert:
5     (3)  The mitigation fee and the water treatment plant
6upgrade fee imposed by this section must be reported to the
7Department of Revenue. Payment of the mitigation and the water
8treatment plant upgrade fees must be accompanied by a form
9prescribed by the Department of Revenue.
10     (a)  The proceeds of the mitigation fee, less
11administrative costs, must be transferred by the Department of
12Revenue to the South Florida Water Management District and
13deposited into the Lake Belt Mitigation Trust Fund.
14     (b)  Beginning January 1, 2012, the proceeds of the water
15treatment plant upgrade fee, less administrative costs, must be
16transferred by the Department of Revenue to the South Florida
17Water Management District and deposited into the Lake Belt
18Mitigation Trust Fund until either:
19     1.  A total of $20 million from the water treatment plant
20upgrade fee proceeds, less administrative costs, is deposited
21into the Lake Belt Mitigation Trust Fund; or
22     2.  The quarterly pathogen sampling conducted as a
23condition of the permits issued by the department for rock
24mining activities in the Miami-Dade Lake Belt Area demonstrates
25that the water in any quarry lake in the vicinity of the
26Northwest Wellfield would be classified as being in Bin Two or
27higher as defined in the Environmental Protection Agency's
28Enhanced Surface Water Treatment Rule.
29     (c)  Upon the earliest occurrence of the criteria under
30either subparagraph (b)1. or subparagraph (b)2., the
