       Senator Richter moved the following:
       
    1         Senate Amendment to House Amendment (766547) to Senate
    2  Amendment (with title amendment)
    3  
    4         Between lines 387 and 388
    5  insert:
    6         Section 8. Subsections (2), (3), and (4) of section
    7  627.072, Florida Statutes, are renumbered as subsections (3),
    8  (4), and (5), respectively, and a new subsection (2) is added to
    9  that section, to read:
   10         627.072 Making and use of rates.—
   11         (2) A retrospective rating plan may contain a provision
   12  that allows negotiation between the employer and insurer to
   13  determine the retrospective rating factors used to calculate the
   14  premium for employers having exposure in more than one state and
   15  an estimated annual countrywide standard premium of $1 million
   16  or more for workers’ compensation.
   17         Section 9. Subsection (2) of section 627.281, Florida
   18  Statutes, is amended to read:
   19         627.281 Appeal from rating organization; workers’
   20  compensation and employer’s liability insurance filings.—
   21         (2) If such appeal is based upon the failure of the rating
   22  organization to make a filing on behalf of such member or
   23  subscriber which is based on a system of expense provisions
   24  which differs, in accordance with the right granted in s.
   25  627.073(3) 627.072(2), from the system of expense provisions
   26  included in a filing made by the rating organization, the office
   27  shall, if it grants the appeal, order the rating organization to
   28  make the requested filing for use by the appellant. In deciding
   29  such appeal, the office shall apply the applicable standards set
   30  forth in ss. 627.062 and 627.072.
