    1                        A bill to be entitled                      
    2         An act relating to Florida Democracy Day; amending s.
    3         110.117, F.S.; providing that the day of a general
    4         election is a paid holiday observed by state branches
    5         and agencies; naming the holiday “Florida Democracy
    6         Day”; reenacting ss. 110.219(5)(c), 551.116, and
    7         849.086(7)(b), F.S., relating to state employee
    8         attendance and leave and days and hours of operation
    9         of slot machine gaming areas and cardrooms,
   10         respectively, to incorporate the amendment to s.
   11         110.117, F.S., in references thereto; providing an
   12         effective date.

   14  Be It Enacted by the Legislature of the State of Florida:
   15  
   16         Section 1. Subsection (1) of section 110.117, Florida
   17  Statutes, is amended to read:
   18         110.117 Paid holidays.—
   19         (1) The following holidays shall be paid holidays observed
   20  by all state branches and agencies:
   21         (a) New Year’s Day.
   22         (b) Birthday of Martin Luther King, Jr., third Monday in
   23  January.
   24         (c) Memorial Day.
   25         (d) Independence Day.
   26         (e) Labor Day.
   27         (f) The day of a general election as defined in s.
   28  97.021(15), which shall be “Florida Democracy Day.”
   29         (g)(f) Veterans’ Day, November 11.
   30         (h)(g) Thanksgiving Day.
   31         (i)(h) Friday after Thanksgiving.
   32         (j)(i) Christmas Day.
   33         (k)(j) If any of these holidays falls on Saturday, the
   34  preceding Friday shall be observed as a holiday. If any of these
   35  holidays falls on Sunday, the following Monday shall be observed
   36  as a holiday.
   37         Section 2. For the purpose of incorporating the amendment
   38  made by this act to section 110.117, Florida Statutes, in a
   39  reference thereto, paragraph (c) of subsection (5) of section
   40  110.219, Florida Statutes, is reenacted to read:
   41         110.219 Attendance and leave; general policies.—
   42         (5) Rules shall be adopted by the department in cooperation
   43  and consultation with the agencies to implement the provisions
   44  of this section; however, such rules must be approved by the
   45  Administration Commission prior to their adoption. Such rules
   46  must provide for, but need not be limited to:
   47         (c) Holidays as provided in s. 110.117.
   48         Section 3. For the purpose of incorporating the amendment
   49  made by this act to section 110.117, Florida Statutes, in a
   50  reference thereto, section 551.116, Florida Statutes, is
   51  reenacted to read:
   52         551.116 Days and hours of operation.—Slot machine gaming
   53  areas may be open daily throughout the year. The slot machine
   54  gaming areas may be open a cumulative amount of 18 hours per day
   55  on Monday through Friday and 24 hours per day on Saturday and
   56  Sunday and on those holidays specified in s. 110.117(1).
   57         Section 4. For the purpose of incorporating the amendment
   58  made by this act to section 110.117, Florida Statutes, in a
   59  reference thereto, paragraph (b) of subsection (7) of section
   60  849.086, Florida Statutes, is reenacted to read:
   61         849.086 Cardrooms authorized.—
   62         (7) CONDITIONS FOR OPERATING A CARDROOM.—
   63         (b) Any cardroom operator may operate a cardroom at the
   64  pari-mutuel facility daily throughout the year, if the
   65  permitholder meets the requirements under paragraph (5)(b). The
   66  cardroom may be open a cumulative amount of 18 hours per day on
   67  Monday through Friday and 24 hours per day on Saturday and
   68  Sunday and on the holidays specified in s. 110.117(1).
   69         Section 5. This act shall take effect July 1, 2012.
