    2         An act relating to the Department of Health; amending
    3         s. 945.602, F.S.; assigning, for administrative
    4         purposes, the Correctional Medical Authority to the
    5         Executive Office of the Governor, rather than the
    6         Department of Health; reducing the membership of the
    7         authority; conforming provisions to changes made by
    8         the act; deleting an obsolete provision; providing for
    9         a transfer of the administration of the Correctional
   10         Medical Authority from the Department of Health to the
   11         Executive Office of the Governor; providing an
   12         effective date.

   14  Be It Enacted by the Legislature of the State of Florida:
   15  
   16         Section 1. Subsections (1) and (3) of section 945.602,
   17  Florida Statutes, are amended to read:
   18         945.602 State of Florida Correctional Medical Authority;
   19  creation; members.—
   20         (1) There is created the State of Florida Correctional
   21  Medical Authority, which for administrative purposes shall be
   22  assigned to the Executive Office of the Governor Department of
   23  Health. The governing board of the authority shall be composed
   24  of seven nine persons appointed by the Governor subject to
   25  confirmation by the Senate. One member must be a member of the
   26  Florida Hospital Association; one member must be a member of the
   27  Florida League of Hospitals; one member must be a member of the
   28  Association of Community Hospitals and Health Systems of
   29  Florida; and one member must be a member of the Florida Medical
   30  Association. The authority shall contract with the Executive
   31  Office of the Governor Department of Health for the provision of
   32  administrative support services, including purchasing,
   33  personnel, general services, and budgetary matters. The
   34  authority is shall not be subject to control, supervision, or
   35  direction by the Executive Office of the Governor Department of
   36  Health or the Department of Corrections. The authority shall
   37  annually elect one member to serve as chair. Members shall be
   38  appointed for terms of 4 years each. Each member may is
   39  authorized to continue to serve upon the expiration of his or
   40  her term until a successor is duly appointed as provided in this
   41  section. Before entering upon his or her duties, each member of
   42  the authority shall take and subscribe to the oath or
   43  affirmation required by the State Constitution.
   44         (3) Effective for new appointments after July 1, 1996, At
   45  least one member of the authority must be a physician licensed
   46  under chapter 458, and one member of the authority may be a
   47  physician licensed under chapter 458 or chapter 459. At least
   48  two other members of the authority must have had at least 5
   49  years’ experience in health care administration.
   50         Section 2. All powers, duties, functions, records, offices,
   51  personnel, associated administrative support positions,
   52  property, pending issues, existing contracts, administrative
   53  authority, and administrative rules relating to the State of
   54  Florida Correctional Medical Authority in the Department of
   55  Health are transferred to the Executive Office of the Governor.
   56         Section 3. This act shall take effect July 1, 2012.
