A bill to be entitled
2An act relating to trust funds; creating s. 403.7451,
3F.S.; creating the Household Pharmaceuticals
4Collection and Disposal Trust Fund within the
5Department of Environmental Protection; providing for
6sources of funds and purposes; providing for annual
7carryforward of funds; providing for the future review
8and termination or re-creation of the trust fund;
9providing a contingent effective date.

11Be It Enacted by the Legislature of the State of Florida:

13     Section 1.  Section 403.7451, Florida Statutes, is created
14to read:
15     403.7451  Household Pharmaceuticals Collection and Disposal
16Trust Fund.-
17     (1)  The Household Pharmaceuticals Collection and Disposal
18Trust Fund is created within the Department of Environmental
19Protection and shall be administered by the Secretary of
20Environmental Protection or his or her designee. Funds credited
21to the trust fund shall consist of funds received from fees
22imposed pursuant to s. 938.16.
23     (2)  The trust fund is established for use as a depository
24for funds to be used for the purposes of the household
25pharmaceuticals collection and disposal grant program
26established in s. 403.745.
27     (3)  Notwithstanding s. 216.301 and pursuant to s. 216.351,
28any balance in the trust fund at the end of any fiscal year
29shall remain in the trust fund at the end of the year and shall
30be available for carrying out the purpose of the trust fund.
31     (4)  In accordance with s. 19(f)(2), Art. III of the State
32Constitution, the trust fund shall, unless terminated sooner, be
33terminated on July 1, 2016. Before its scheduled termination,
34the trust fund shall be reviewed as provided in s. 215.3206(1)
35and (2).
36     Section 2.  This act shall take effect July 1, 2012, if
37House Bill 333 or similar legislation is adopted in the same
38legislative session or an extension thereof and becomes law.
