A bill to be entitled
2An act relating to electrolysis; amending s. 478.42,
3F.S.; defining the term "indirect supervision";
4creating s. 478.451, F.S.; requiring a licensed
5electrologist who performs hair removal or reduction
6using laser or light-based technology to practice
7under a protocol with a licensed physician or
8osteopathic physician, subject to specified training
9and supervision; amending ss. 458.348 and 459.025,
10F.S.; revising supervision requirements for persons
11performing electrolysis using laser or light-based
12hair removal or reduction under practice protocols who
13are not licensed physicians or osteopathic physicians;
14providing an effective date.

16Be It Enacted by the Legislature of the State of Florida:
17
18     Section 1.  Subsection (6) is added to section 478.42,
19Florida Statutes, to read:
20     478.42  Definitions.-As used in this chapter, the term:
21     (6)  "Indirect supervision" means supervision of an
22electrologist by a physician who is not on the premises but
23practices at a location within 20 miles or 30 minutes of the
24practice location of the supervised electrologist and is readily
25available for consultation as needed.
26     Section 2.  Section 478.451, Florida Statutes, is created
27to read:
28     478.451  Formal supervisory relationships.-
29     (1)  A person licensed as an electrologist under this
30chapter who performs hair removal or reduction using laser or
31light-based technology must practice under a protocol with a
32physician licensed under chapter 458 or chapter 459.
33     (2)  All protocols relating to electrolysis or electrology
34using laser or light-based hair removal or reduction must
35require the licensed electrologist to be appropriately trained
36and work under the indirect supervision of a physician licensed
37under chapter 458 or chapter 459.
38     Section 3.  Subsection (3) of section 458.348, Florida
39Statutes, is amended to read:
40     458.348  Formal supervisory relationships, standing orders,
41and established protocols; notice; standards.-
42     (3)  PROTOCOLS RELATING TO LASER OR LIGHT-BASED HAIR
43REMOVAL OR REDUCTION REQUIRING DIRECT SUPERVISION.-All protocols
44relating to electrolysis or electrology using laser or light-
45based hair removal or reduction by persons other than physicians
46licensed under this chapter or chapter 459 shall require the
47person performing such service to be appropriately trained and
48work only under the direct supervision and responsibility of a
49physician licensed under this chapter or chapter 459. The
50supervisory physician under the protocol is not required to be
51onsite when the service is performed.
52     Section 4.  Subsection (2) of section 459.025, Florida
53Statutes, is amended to read:
54     459.025  Formal supervisory relationships, standing orders,
55and established protocols; notice; standards.-
56     (2)  PROTOCOLS RELATING TO LASER OR LIGHT-BASED HAIR
57REMOVAL OR REDUCTION REQUIRING DIRECT SUPERVISION.-All protocols
58relating to electrolysis or electrology using laser or light-
59based hair removal or reduction by persons other than
60osteopathic physicians licensed under this chapter or chapter
61458 shall require the person performing such service to be
62appropriately trained and to work only under the direct
63supervision and responsibility of a an osteopathic physician
64licensed under this chapter or chapter 458. The supervisory
65physician under the protocol is not required to be onsite when
66the service is performed.
67     Section 5.  This act shall take effect upon becoming a law.
