2An act relating to educational plant surveys; amending
3s. 1013.31, F.S.; authorizing an extension to a school
4district educational plant survey submission deadline;
5providing restrictions; providing requirements for the
6submission of a request for an extension to the
7Department of Education and requiring department
8approval; providing restrictions on school district
9construction during the extension period; requiring
10the State Board of Education to adopt rules; providing
11an effective date.

13Be It Enacted by the Legislature of the State of Florida:
14
15     Section 1.  Paragraph (e) is added to subsection (1) of
16section 1013.31, Florida Statutes, to read:
17     1013.31  Educational plant survey; localized need
18assessment; PECO project funding.-
19     (1)  At least every 5 years, each board shall arrange for
20an educational plant survey, to aid in formulating plans for
21housing the educational program and student population, faculty,
22administrators, staff, and auxiliary and ancillary services of
23the district or campus, including consideration of the local
24comprehensive plan. The Department of Education shall document
25the need for additional career and adult education programs and
26the continuation of existing programs before facility
27construction or renovation related to career or adult education
28may be included in the educational plant survey of a school
29district or Florida College System institution that delivers
30career or adult education programs. Information used by the
31Department of Education to establish facility needs must
32include, but need not be limited to, labor market data, needs
33analysis, and information submitted by the school district or
34Florida College System institution.
35     (e)  Request for extension.-
36     1.  Upon request by a district school superintendent to the
37Department of Education and upon approval by the department, an
38extension to a survey submission deadline may be granted for up
39to 180 days, not to exceed four consecutive extensions per
40survey. A request for an extension to a survey submission
41deadline must be submitted to the department no later than 90
42days prior to the current submission deadline. A request shall
43contain the following:
44     a.  A letter from the district school superintendent to the
45department, submitted on behalf of the district school board and
46on district school board letterhead, formally requesting an
47extension which cites the specific need for the extension.
48     b.  A formal application, developed by the department, that
49includes sections for the following information: the purpose for
50requesting the extension; data that clearly and objectively
51supports the need for the extension; the signatures of all
52current district school board members; and the signature of the
53director of the department responsible for oversight of the
54educational facility planning, design, and construction for the
55school district, if one exists.
56     2.  School districts may not contract for new construction
57projects, except for local bonded projects and those financed
58with the voter-approved one-half-cent cent sales surtax for
59public school capital outlay authorized by s. 212.055(6), during
60an extension period.
61     3.  The State Board of Education shall adopt rules pursuant
62to ss. 120.536(1) and 120.54 to implement this paragraph.
63     Section 2.  This act shall take effect July 1, 2012.
