    1                        A bill to be entitled                      
    2         An act relating to the artificial coloring and sale of
    3         certain animals and fowls; creating s. 828.1615, F.S.;
    4         providing that it is unlawful for a person to dye or
    5         artificially color any animal or fowl; providing that
    6         it is unlawful to sell or give away animals of a
    7         certain age; providing exceptions; providing criminal
    8         penalties; providing an effective date.

   10  Be It Enacted by the Legislature of the State of Florida:
   11  
   12         Section 1. Section 828.1615, Florida Statutes, is created
   13  to read:
   14         828.1615Prohibiting artificial coloring and sale of
   15  certain animals and fowls; construction.
   16         (1) It is unlawful for a person to dye or artificially
   17  color any animal or fowl, including, but not limited to,
   18  rabbits, baby chickens, and ducklings, or to bring a dyed or
   19  artificially colored animal or fowl into this state.
   20         (2)It is unlawful for a person to sell, offer for sale, or
   21  give away as merchandising premiums, baby chickens, ducklings,
   22  or other fowl under 4 weeks of age or rabbits under 2 months of
   23  age to be used as pets, toys, or retail premiums.
   24         (3)This section does not apply to any animal or fowl,
   25  including, but not limited to, rabbits, baby chickens, and
   26  ducklings, to be used or raised for agricultural purposes by
   27  persons with proper facilities to care for them or for poultry
   28  or livestock exhibitions.
   29         (4)A person violating this section commits a misdemeanor
   30  of the second degree, punishable as provided in s. 775.082 or s.
   31  775.083..
   32         Section 2. This act shall take effect July 1, 2013.
