       Senator Flores moved the following:
       
    1         Senate Amendment 
    2  
    3         Delete lines 754 - 773
    4  and insert:
    5  
    6         (12)(a) An obligor may file a petition for modification or
    7  termination of an alimony award based on his or her retirement.
    8  If granted, the modification or termination of the alimony award
    9  shall become effective upon the later of the date of filing the
   10  petition for modification or termination, or the retirement
   11  date.
   12         (b) A finding that an obligor has reached the age for
   13  retirement for full social security benefits or if younger, the
   14  customary retirement age for his or her occupation and has
   15  retired from this profession shall be considered a substantial
   16  change in circumstances as a matter of law. In determining
   17  whether the obligor’s retirement is reasonable, the court shall
   18  consider the obligor’s:
   19         1. Age,
   20         2. Health, and
   21         3. Type of work.
   22         (c) If the court finds the obligor’s retirement is
   23  reasonable pursuant to paragraph (b), the court shall modify or
   24  terminate the alimony award if warranted after consideration of
   25  the financial circumstances of the parties.
