       Senator Soto moved the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Between lines 114 and 115
    4  insert:
    5         Section 6. (1) For purposes of this section, the term
    6  “algae bloom” includes, but is not limited to, periphyton,
    7  phytoplankton, and macroalgae occupying an area of at least
    8  10,000 square feet in a water of the state.
    9         (2) The Department of Environmental Protection shall submit
   10  a report to the Governor, the President of the Senate, and the
   11  Speaker of the House of Representatives before January 1, 2014,
   12  disclosing the following information regarding exposure to
   13  freshwater or saltwater containing an algae bloom:
   14         (a) The number of children and adults diagnosed with skin
   15  rashes, acute respiratory illness, or gastrointestinal symptoms
   16  occurring within 10 minutes of exposure.
   17         (b) The number of domestic dogs and livestock that died
   18  within 3 hours of exposure.
   19         (c) The number of manatees and seabirds that died within 30
   20  days of exposure.
   21         (d) For each water body containing an algae bloom
   22  associated with any of the reported incidents described in
   23  paragraphs (a) through (c), whether the department’s numeric
   24  nutrient rules were violated between January 1, 2013, and
   25  January 1, 2014.
   26         (3) If the total number of reported incidents described in
   27  subsection (2) exceeds 100, the Department of Environmental
   28  Protection shall substitute the numeric nutrient rules in this
   29  act with those proposed or adopted by the United States
   30  Environmental Protection Agency.
