    1                        A bill to be entitled                      
    2         An act relating to the delivery of insurance policies;
    3         amending s. 627.421, F.S.; providing that an insurance
    4         policy may be delivered by electronic means;
    5         specifying the types of policies that can be delivered
    6         electronically; requiring that a paper copy of the
    7         policy be provided upon request; providing an
    8         effective date.

   10  Be It Enacted by the Legislature of the State of Florida:
   11  
   12         Section 1. Subsection (1) of section 627.421, Florida
   13  Statutes, is amended to read:
   14         627.421 Delivery of policy.—
   15         (1) Subject to the insurer’s requirement as to payment of
   16  premium, every policy shall be mailed, or delivered, or
   17  electronically transmitted to the insured or to the person
   18  entitled thereto within not later than 60 days after the
   19  effectuation of coverage. Electronic transmission of a policy
   20  for commercial risks, including, but not limited to, workers’
   21  compensation and employers’ liability, commercial automobile
   22  liability, commercial automobile physical damage, commercial
   23  lines residential property, commercial nonresidential property,
   24  farm owners insurance, and the types of commercial lines risks
   25  set forth in s. 627.062(3)(d), constitutes delivery to the
   26  insured or to the person entitled to delivery. The transmission
   27  must include notice to the insured, or to the person entitled to
   28  delivery, of his or her right to receive the policy via United
   29  States mail rather than via electronic transmission. If the
   30  insured or the person entitled to delivery communicates to the
   31  insurer electronically or in writing that he or she does not
   32  agree to delivery by electronic means, a paper copy of the
   33  policy shall be provided to the insured or the person entitled
   34  to delivery.
   35         Section 2. This act shall take effect upon becoming a law.
