       Senator Brandes moved the following:
       
    1         Senate Amendment to Amendment (218538) (with title
    2  amendment)
    3  
    4         Delete lines 1007 - 1037
    5  and insert:
    6         Section 25. Paragraph (a) of subsection (2) and paragraph
    7  (a) of subsection (5) of section 320.02, Florida Statutes, are
    8  amended, and paragraph (s) is added to subsection (15), to read:
    9         320.02 Registration required; application for registration;
   10  forms.—
   11         (2)(a) The application for registration must shall include
   12  the street address of the owner’s permanent residence or the
   13  address of his or her permanent place of business and shall be
   14  accompanied by personal or business identification information.
   15  An individual applicant must provide which may include, but need
   16  not be limited to, a valid driver license or number, Florida
   17  identification card issued by this state or another state or a
   18  valid passport. A business applicant must provide a number, or
   19  federal employer identification number, if applicable, or
   20  verification that the business is authorized to conduct business
   21  in the state, or a Florida municipal or county business license
   22  or number.
   23         1. If the owner does not have a permanent residence or
   24  permanent place of business or if the owner’s permanent
   25  residence or permanent place of business cannot be identified by
   26  a street address, the application must shall include:
   27         a.1. If the vehicle is registered to a business, the name
   28  and street address of the permanent residence of an owner of the
   29  business, an officer of the corporation, or an employee who is
   30  in a supervisory position.
   31         b.2. If the vehicle is registered to an individual, the
   32  name and street address of the permanent residence of a close
   33  relative or friend who is a resident of this state.
   34         2. If the vehicle is registered to an active duty member of
   35  the Armed Forces of the United States who is a Florida resident,
   36  the active duty member is exempt from the requirement to provide
   37  the street address of a permanent residence.
   38         (5)(a) Proof that personal injury protection benefits have
   39  been purchased if when required under s. 627.733, that property
   40  damage liability coverage has been purchased as required under
   41  s. 324.022, that bodily injury or death coverage has been
   42  purchased if required under s. 324.023, and that combined bodily
   43  liability insurance and property damage liability insurance have
   44  been purchased if when required under s. 627.7415 shall be
   45  provided in the manner prescribed by law by the applicant at the
   46  time of application for registration of any motor vehicle that
   47  is subject to such requirements. The issuing agent shall refuse
   48  to issue registration if such proof of purchase is not provided.
   49  Insurers shall furnish uniform proof-of-purchase cards in a
   50  paper or electronic format in a form prescribed by the
   51  department and shall include the name of the insured’s insurance
   52  company, the coverage identification number, and the make, year,
   53  and vehicle identification number of the vehicle insured. The
   54  card must shall contain a statement notifying the applicant of
   55  the penalty specified under in s. 316.646(4). The card or
   56  insurance policy, insurance policy binder, or certificate of
   57  insurance or a photocopy of any of these; an affidavit
   58  containing the name of the insured’s insurance company, the
   59  insured’s policy number, and the make and year of the vehicle
   60  insured; or such other proof as may be prescribed by the
   61  department shall constitute sufficient proof of purchase. If an
   62  affidavit is provided as proof, it must shall be in
   63  substantially the following form:

   65  Under penalty of perjury, I ...(Name of insured)... do hereby
   66  certify that I have ...(Personal Injury Protection, Property
   67  Damage Liability, and, if when required, Bodily Injury
   68  Liability)... Insurance currently in effect with ...(Name of
   69  insurance company)... under ...(policy number)... covering
   70  ...(make, year, and vehicle identification number of
   71  vehicle).... ...(Signature of Insured)...

   73  Such affidavit must shall include the following warning:

   75  WARNING: GIVING FALSE INFORMATION IN ORDER TO OBTAIN A VEHICLE
   76  REGISTRATION CERTIFICATE IS A CRIMINAL OFFENSE UNDER FLORIDA
   77  LAW. ANYONE GIVING FALSE INFORMATION ON THIS AFFIDAVIT IS
   78  SUBJECT TO PROSECUTION.

   80  If When an application is made through a licensed motor vehicle
   81  dealer as required under in s. 319.23, the original or a
   82  photostatic copy of such card, insurance policy, insurance
   83  policy binder, or certificate of insurance or the original
   84  affidavit from the insured shall be forwarded by the dealer to
   85  the tax collector of the county or the Department of Highway
   86  Safety and Motor Vehicles for processing. By executing the
   87  aforesaid affidavit, no licensed motor vehicle dealer will be
   88  liable in damages for any inadequacy, insufficiency, or
   89  falsification of any statement contained therein. A card must
   90  shall also indicate the existence of any bodily injury liability
   91  insurance voluntarily purchased.

   93         (s) The application form for motor vehicle registration and
   94  renewal registration must include language permitting a
   95  voluntary contribution of $1 or more per applicant, which shall
   96  be distributed to the Auto Club Group Traffic Safety Foundation,
   97  Inc., a nonprofit organization. Funds received by the foundation
   98  must be used to improve traffic safety culture in communities
   99  through effective outreach, education, and activities in the
  100  state which will save lives, reduce injuries, and prevent
  101  crashes. The foundation must comply with s. 320.023.

  103  For the purpose of applying the service charge provided in s.
  104  215.20, contributions received under this subsection are not
  105  income of a revenue nature.

  117         Safety Foundation, Inc.; amending s. 320.03, F.S.;
