       The Committee on Banking and Insurance (Ring) recommended the
       following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Delete lines 202 - 214
    4  and insert:
    5         Section 5. Paragraph (b) of subsection (7) of section
    6  440.107, Florida Statutes, is amended, and subsection (16) is
    7  added to that section, to read:
    8         440.107 Department powers to enforce employer compliance
    9  with coverage requirements.—
   10         (7)
   11         (b) Stop-work orders and penalty assessment orders issued
   12  under this section against a corporation, limited liability
   13  company, partnership, or sole proprietorship shall be in effect
   14  against any successor corporation or business entity that has
   15  one or more of the same principals or officers as the
   16  corporation, limited liability company, or partnership against
   17  which the stop-work order was issued and are engaged in the same
   18  or equivalent trade or activity.
   19         (16) A temporary lapse of coverage by an employer in which
   20  an employer’s insurance policy is canceled for non-payment of
   21  premium and is reinstated retroactively to the date of
   22  cancellation by the employer’s insurance carrier within 10 days
   23  of such cancellation may not constitute a failure by the
   24  employer to comply with the workers’ compensation coverage
   25  requirements under this chapter.

   28         And the title is amended as follows:
   29         Between lines 13 and 14
   30  insert:
   31         prohibiting a specified lapse in coverage by an
   32         employer from constituting a failure to comply with
   33         the Workers’ Compensation Law;
