       The Committee on Appropriations (Joyner) recommended the
       following:
       
    1         Senate Amendment (with directory and title amendments)

    4  insert:
    5         (18) FACILITIES.—
    6         (e) If a district school board facility or property is
    7  available because it is surplus, marked for disposal, or
    8  otherwise unused, it shall be provided for a charter school’s
    9  use on the same basis as it is made available to other public
   10  schools in the district. A charter school that occupies the
   11  property of a public school must pay for an appraisal of the
   12  public school property to compute the local commercial per
   13  square foot rental rate for the public school property. The
   14  charter school shall pay the per square foot amount as monthly
   15  rent to the district school board to reduce the bonds that are
   16  owed by the school district. A charter school receiving property
   17  from the school district may not sell or dispose of such
   18  property without written permission of the school district.
   19  Similarly, for an existing public school converting to charter
   20  status, no rental or leasing fee for the existing facility or
   21  for the property normally inventoried to the conversion school
   22  may be charged by the district school board to the parents and
   23  teachers organizing the charter school. The charter school shall
   24  agree to reasonable maintenance provisions in order to maintain
   25  the facility in a manner similar to district school board
   26  standards. The Public Education Capital Outlay maintenance funds
   27  or any other maintenance funds generated by the facility
   28  operated as a conversion school shall remain with the conversion
   29  school.

   34  and insert:
   35         Section 4. Paragraph (b) of subsection (16) and paragraph
   36  (e) of subsection (18) of section 1002.33, Florida Statutes, are
   37  amended to read:

   41         Delete line 15
   42  and insert:
   43         the assignment of teachers; requiring a charter school
   44         using public school property to pay for a property
   45         appraisal and to pay rent to the district school
   46         board; creating s. 1003.07, F.S.;
