5 Section 4. Paragraph (b) of subsection (1) of section
6 28.35, Florida Statutes, is amended to read:
7 28.35 Florida Clerks of Court Operations Corporation.—
8 (1)
9 (b)1. The executive council shall be composed of eight
10 clerks of the court elected by the clerks of the courts for a
11 term of 2 years, with two clerks from counties with a population
12 of fewer than 100,000, two clerks from counties with a
13 population of at least 100,000 but fewer than 500,000, two
14 clerks from counties with a population of at least 500,000 but
15 fewer than 1 million, and two clerks from counties with a
16 population of more than 1 million or more. The executive council
17 shall also include, as ex officio members, a designee of the
18 President of the Senate and a designee of the Speaker of the
19 House of Representatives. The Chief Justice of the Supreme Court
20 shall designate one additional member to represent the state
21 courts system.
22 2. The Legislature determines that it is in the public
23 interest that a member of the executive council of the
24 corporation be subject to the requirements of ss. 112.313,
25 112.3135, and 112.3143(2). Notwithstanding that the council
26 members are not public officers or employees, for purposes of
27 the application of ss. 112.313, 112.3135, and 112.3143(2) to the
28 activities of the council members, the council members shall be
29 considered public officers or employees, and the corporation
30 shall be considered their agency.
31 3. A member of the executive council of the corporation may
32 not represent another person or entity for compensation before
33 the corporation for a period of 2 years following his or her
34 service on the executive council.
