    1                        A bill to be entitled                      
    2         An act relating to the state minimum wage; amending s.
    3         448.110, F.S.; increasing the state minimum wage;
    4         providing that an employer may not pay an employee at
    5         a rate less than the state minimum wage; deleting the
    6         requirement that only individuals entitled to receive
    7         the federal minimum wage are eligible to receive the
    8         state minimum wage; providing an effective date.

   10  Be It Enacted by the Legislature of the State of Florida:
   11  
   12         Section 1. Subsection (3) of section 448.110, Florida
   13  Statutes, is amended to read:
   14         448.110 State minimum wage; annual wage adjustment;
   15  enforcement.—
   16         (3) Effective May 2, 2005, Employers shall pay employees a
   17  minimum wage at an hourly rate of $10.10 $6.15 for all hours
   18  worked in this state Florida. An employer may not pay an
   19  employee at a rate less than the state minimum wage Only those
   20  individuals entitled to receive the federal minimum wage under
   21  the federal Fair Labor Standards Act and its implementing
   22  regulations shall be eligible to receive the state minimum wage
   23  pursuant to s. 24, Art. X of the State Constitution and this
   24  section. The provisions of ss. 213 and 214 of the federal Fair
   25  Labor Standards Act, as interpreted by applicable federal
   26  regulations and implemented by the Secretary of Labor, are
   27  incorporated herein.
   28         Section 2. This act shall take effect January 1, 2015.
