    5         An act establishing the congressional districts of the
    6         state; amending s. 8.0002, F.S.; revising the state’s
    7         congressional districts created by chapter 2012-2,
    8         Laws of Florida, in accordance with the United States
    9         Decennial Census of 2010 (plan H000C9057); reenacting
   10         s. 8.0111, F.S., relating to the inclusion of unlisted
   11         territory in contiguous districts; reenacting s.
   12         8.031, F.S., relating to the election of
   13         representatives to the United States House of
   14         Representatives; reenacting s. 8.0611, F.S., relating
   15         to severability; amending s. 8.07, F.S.; providing
   16         applicability; providing an effective date.
   17  
   18         WHEREAS, in chapter 2012-2, Laws of Florida, the
   19  Legislature reapportioned the state’s congressional districts in
   20  accordance with the United States Decennial Census of 2010, and
   21         WHEREAS, it is the intent of the Legislature to revise the
   22  boundaries of Congressional Districts 5 and 10 to conform with
   23  the Final Judgment issued in Romo v. Detzner, consolidated case
   24  Nos. 2012-CA-412 and 2012-CA-490, in the Circuit Court of the
   25  Second Judicial Circuit in and for Leon County, and to make
   26  conforming changes to districts that are a direct result of the
   27  changes to Congressional Districts 5 and 10, and
   28         WHEREAS, it is the intent of the Legislature, where not in
   29  conflict with federal law or subsection (a) of section 20 of
   30  Article III of the State Constitution, to establish districts
   31  that are compact and, where feasible, utilize existing political
   32  and geographical boundaries, and
   33         WHEREAS, it is the intent of the Legislature to establish
   34  Congressional District 1, which is equal in population to other
   35  districts; is compact; includes all of Escambia, Okaloosa, Santa
   36  Rosa, and Walton Counties and portions of Holmes County;
   37  includes all of the municipalities of Century, Cinco Bayou,
   38  Crestview, DeFuniak Springs, Destin, Esto, Fort Walton Beach,
   39  Freeport, Gulf Breeze, Jay, Laurel Hill, Mary Esther, Milton,
   40  Niceville, Noma, Paxton, Pensacola, Ponce de Leon, Shalimar,
   41  Valparaiso, and Westville; follows the boundaries of the state
   42  on the western and northern sides of the district and the Gulf
   43  of Mexico on the south, and
   44         WHEREAS, it is the intent of the Legislature to establish
   45  Congressional District 2, which is equal in population to other
   46  districts; is compact; includes all of Bay, Calhoun, Franklin,
   47  Gadsden, Gulf, Jackson, Jefferson, Leon, Liberty, Taylor,
   48  Wakulla, and Washington Counties and portions of Holmes and
   49  Madison Counties; includes all of the municipalities of Alford,
   50  Altha, Apalachicola, Bascom, Blountstown, Bonifay, Bristol,
   51  Callaway, Campbellton, Carrabelle, Caryville, Chattahoochee,
   52  Chipley, Cottondale, Ebro, Graceville, Grand Ridge, Greensboro,
   53  Greenville, Greenwood, Gretna, Havana, Jacob City, Lynn Haven,
   54  Malone, Marianna, Mexico Beach, Midway, Monticello, Panama City,
   55  Panama City Beach, Parker, Perry, Port St. Joe, Quincy, St.
   56  Marks, Sneads, Sopchoppy, Springfield, Tallahassee, Vernon,
   57  Wausau, and Wewahitchka, and
   58         WHEREAS, it is the intent of the Legislature to establish
   59  Congressional District 3, which is equal in population to other
   60  districts; is compact; includes all of Bradford, Columbia,
   61  Dixie, Gilchrist, Hamilton, Lafayette, Levy, Suwannee, and Union
   62  Counties and portions of Alachua, Clay, Madison, and Marion
   63  Counties; includes all of the municipalities of Alachua, Archer,
   64  Bell, Branford, Bronson, Brooker, Cedar Key, Chiefland, Cross
   65  City, Dunnellon, Fanning Springs, Fort White, Hampton, High
   66  Springs, Horseshoe Beach, Inglis, Jasper, Jennings, Keystone
   67  Heights, La Crosse, Lake Butler, Lake City, Lawtey, Lee, Live
   68  Oak, Madison, Mayo, Micanopy, Newberry, Otter Creek, Penney
   69  Farms, Raiford, Starke, Trenton, Waldo, White Springs,
   70  Williston, Worthington Springs, and Yankeetown; and uses
   71  Interstate 75, State Road 200, Highway 17, and the Ocala city
   72  line as portions of its eastern boundary, and
   73         WHEREAS, it is the intent of the Legislature to establish
   74  Congressional District 4, which is equal in population to other
   75  districts; is compact; includes all of Baker and Nassau Counties
   76  and portions of Duval County; includes all of the municipalities
   77  of Atlantic Beach, Baldwin, Callahan, Fernandina Beach, Glen St.
   78  Mary, Hilliard, Jacksonville Beach, Macclenny, and Neptune
   79  Beach; and follows the boundaries of the state to the north, the
   80  Atlantic Ocean to the east, and county boundaries to the west
   81  and south, and
   82         WHEREAS, it is the intent of the Legislature to establish
   83  Congressional District 5, which is equal in population to other
   84  districts; is as compact as the minority protection provisions
   85  in tier 1 permit; does not deny or abridge the equal opportunity
   86  of racial or language minorities to participate in the political
   87  process or diminish their ability to elect representatives of
   88  their choice; preserves the core of the existing district in
   89  accordance with public testimony, is culturally and
   90  demographically compact, and ties communities in Northeast
   91  Florida of similar socioeconomic and historical characteristics;
   92  includes portions of Alachua, Clay, Duval, Lake, Marion, Orange,
   93  and Putnam Counties; includes all of the municipalities of
   94  Eatonville, Green Cove Springs, Hawthorne, Interlachen,
   95  McIntosh, Palatka, and Reddick; improves the use of existing
   96  county, city, political, and geographic boundaries as compared
   97  to the comparable district in the benchmark plan; and uses the
   98  St. Johns River and other waterways as large portions of its
   99  eastern boundary, and
  100         WHEREAS, it is the intent of the Legislature to establish
  101  Congressional District 6, which is equal in population to other
  102  districts; is compact; includes all of Flagler and St. Johns
  103  Counties and portions of Putnam and Volusia Counties; includes
  104  all of the municipalities of Beverly Beach, Bunnell, Crescent
  105  City, Daytona Beach, Daytona Beach Shores, DeLand, Edgewater,
  106  Flagler Beach, Hastings, Holly Hill, Lake Helen, Marineland, New
  107  Smyrna Beach, Oak Hill, Ormond Beach, Palm Coast, Pierson,
  108  Pomona Park, Ponce Inlet, Port Orange, St. Augustine, St.
  109  Augustine Beach, South Daytona, and Welaka; and uses the St.
  110  Johns County line, the Volusia County line, and the Atlantic
  111  Ocean for portions of its western and eastern borders and is
  112  traversed by Interstate 95, and
  113         WHEREAS, it is the intent of the Legislature to establish
  114  Congressional District 7, which is equal in population to other
  115  districts; is compact; includes all of Seminole County and
  116  portions of Orange and Volusia Counties; includes all of the
  117  municipalities of Altamonte Springs, Casselberry, Deltona, Lake
  118  Mary, Longwood, Maitland, Oviedo, Sanford, Winter Park, and
  119  Winter Springs; follows the boundary of Seminole County along
  120  much of its western and southern boundaries; is bounded on the
  121  east by the Brevard County line; and is traversed by the
  122  Seminole Expressway and Interstate 4, and
  123         WHEREAS, it is the intent of the Legislature to establish
  124  Congressional District 8, which is equal in population to other
  125  districts; is compact; includes all of Brevard and Indian River
  126  Counties and portions of Orange County; includes all of the
  127  municipalities of Cape Canaveral, Cocoa, Cocoa Beach, Fellsmere,
  128  Grant-Valkaria, Indialantic, Indian Harbour Beach, Indian River
  129  Shores, Malabar, Melbourne, Melbourne Beach, Melbourne Village,
  130  Orchid, Palm Bay, Palm Shores, Rockledge, Satellite Beach,
  131  Sebastian, Titusville, Vero Beach, and West Melbourne; is
  132  bounded by county lines and by the Atlantic Ocean; and is
  133  traversed by Interstate 95, U.S. Highway 1, and State Road A1A,
  134  and
  135         WHEREAS, it is the intent of the Legislature to establish
  136  Congressional District 9, which is equal in population to other
  137  districts; is compact; includes portions of Osceola and Orange
  138  Counties; includes all of the municipalities of Belle Isle,
  139  Edgewood, Kissimmee, and St. Cloud; and ties high growth central
  140  Florida communities of similar language characteristics, and
  141         WHEREAS, it is the intent of the Legislature to establish
  142  Congressional District 10, which is equal in population to other
  143  districts; is compact; includes portions of Lake, Osceola,
  144  Orange, and Polk Counties; includes all of the municipalities of
  145  Astatula, Auburndale, Bay Lake, Clermont, Davenport, Eustis,
  146  Groveland, Haines City, Howey-in-the-Hills, Lake Alfred, Lake
  147  Buena Vista, Lake Hamilton, Leesburg, Mascotte, Minneola,
  148  Montverde, Mount Dora, Oakland, Polk City, Tavares, Umatilla,
  149  Windermere, and Winter Garden; and is traversed by Interstate 4
  150  and the Florida Turnpike, and
  151         WHEREAS, it is the intent of the Legislature to establish
  152  Congressional District 11, which is equal in population to other
  153  districts; is compact; includes all of Citrus, Hernando, and
  154  Sumter Counties and portions of Lake and Marion Counties;
  155  includes all of Belleview, Brooksville, Bushnell, Center Hill,
  156  Coleman, Crystal River, Fruitland Park, Inverness, Lady Lake,
  157  Ocala, Webster, Weeki Wachee, and Wildwood; and uses Interstate
  158  75, State Road 200, and the Ocala city line as portions of its
  159  western border, and
  160         WHEREAS, it is the intent of the Legislature to establish
  161  Congressional District 12, which is equal in population to other
  162  districts; is compact; includes all of Pasco County and portions
  163  of Hillsborough and Pinellas Counties; includes all of the
  164  municipalities of Dade City, New Port Richey, Oldsmar, Port
  165  Richey, St. Leo, San Antonio, Tarpon Springs, and Zephyrhills;
  166  and uses the Dale Mabry Highway as portions of its eastern
  167  border and is traversed by the Suncoast Parkway, Interstate 75,
  168  and U.S. Highways 19 and 98, and
  169         WHEREAS, it is the intent of the Legislature to establish
  170  Congressional District 13, which is equal in population to other
  171  districts; is compact; is wholly located in Pinellas County;
  172  includes all of the municipalities of Belleair, Belleair Beach,
  173  Belleair Bluffs, Belleair Shore, Clearwater, Dunedin, Gulfport,
  174  Indian Rocks Beach, Indian Shores, Kenneth City, Largo, Madeira
  175  Beach, North Redington Beach, Pinellas Park, Redington Beach,
  176  Redington Shores, Safety Harbor, St. Pete Beach, Seminole, South
  177  Pasadena, and Treasure Island; and uses the Hillsborough
  178  Pinellas border and Interstate 275 as portions of its western
  179  border and follows city lines of Dunedin and Clearwater on the
  180  northern border, and
  181         WHEREAS, it is the intent of the Legislature to establish
  182  Congressional District 14, which is equal in population to other
  183  districts; complies with Section 5 of the federal Voting Rights
  184  Act; does not deny or abridge the equal opportunity of racial or
  185  language minorities to participate in the political process or
  186  diminish their ability to elect representatives of their choice;
  187  ties urban neighborhoods of similar socioeconomic
  188  characteristics in the Tampa Bay area; is compact; includes
  189  portions of Hillsborough and Pinellas Counties; includes
  190  portions of the municipalities of St. Petersburg and Tampa; and
  191  uses Interstate 75 as a portion of its eastern boundary and
  192  portions of the Hillsborough-Pinellas border and Interstate 275
  193  as portions of its western border, and
  194         WHEREAS, it is the intent of the Legislature to establish
  195  Congressional District 15, which is equal in population to other
  196  districts; is compact; includes portions of Hillsborough and
  197  Polk Counties; includes all of the municipalities of Bartow,
  198  Lakeland, Mulberry, Plant City, and Temple Terrace; and uses the
  199  Alafia River as a portion of its southern boundary, Interstate
  200  75 as a portion of its western boundary, and the Lakeland,
  201  Auburndale, and Bartow city lines for portions of its eastern
  202  border, and
  203         WHEREAS, it is the intent of the Legislature to establish
  204  Congressional District 16, which is equal in population to other
  205  districts; is compact; includes all of Sarasota County and
  206  portions of Manatee County; includes all of the municipalities
  207  of Anna Maria, Bradenton, Bradenton Beach, Holmes Beach,
  208  Longboat Key, North Port, Palmetto, Sarasota, and Venice; and is
  209  traversed by Interstate 75, and
  210         WHEREAS, it is the intent of the Legislature to establish
  211  Congressional District 17, which is equal in population to other
  212  districts; is compact; includes all of Charlotte, DeSoto,
  213  Glades, Hardee, Highlands, and Okeechobee Counties and portions
  214  of Hillsborough, Lee, Manatee, Osceola, and Polk Counties;
  215  includes all of the municipalities of Arcadia, Avon Park,
  216  Bowling Green, Dundee, Eagle Lake, Fort Meade, Frostproof,
  217  Highland Park, Hillcrest Heights, Lake Placid, Lake Wales, Moore
  218  Haven, Okeechobee, Punta Gorda, Sebring, Wauchula, and Zolfo
  219  Springs; and uses the Alafia River and the Bartow and Dundee
  220  city lines as portions of its northern border, and
  221         WHEREAS, it is the intent of the Legislature to establish
  222  Congressional District 18, which is equal in population to other
  223  districts; is compact; includes all of Martin and St. Lucie
  224  Counties and portions of Palm Beach County; includes all of the
  225  municipalities of Fort Pierce, Juno Beach, Jupiter, Jupiter
  226  Inlet Colony, Jupiter Island, North Palm Beach, Ocean Breeze
  227  Park, Palm Beach Gardens, Palm Beach Shores, Port St. Lucie, St.
  228  Lucie Village, Sewall’s Point, Stuart, and Tequesta; and is
  229  traversed by Interstate 95 and the Florida Turnpike, and
  230         WHEREAS, it is the intent of the Legislature to establish
  231  Congressional District 19, which is equal in population to other
  232  districts; is compact; includes portions of Collier and Lee
  233  Counties; includes all of the municipalities of Bonita Springs,
  234  Cape Coral, Fort Myers, Fort Myers Beach, Marco Island, Naples,
  235  and Sanibel; and is traversed by Interstate 75 and the Tamiami
  236  Trail, and
  237         WHEREAS, it is the intent of the Legislature to establish
  238  Congressional District 20, which is equal in population to other
  239  districts; complies with Sections 2 and 5 of the federal Voting
  240  Rights Act; does not deny or abridge the equal opportunity of
  241  racial or language minorities to participate in the political
  242  process or diminish their ability to elect representatives of
  243  their choice; ties communities of similar socioeconomic
  244  characteristics in Broward, Palm Beach, and Hendry Counties; is
  245  compact; includes portions of Broward, Hendry, and Palm Beach
  246  Counties; includes all of the municipalities of Belle Glade,
  247  Clewiston, Cloud Lake, Glen Ridge, Haverhill, Lake Park,
  248  Lauderdale Lakes, Lauderhill, Loxahatchee Groves, Mangonia Park,
  249  North Lauderdale, Pahokee, South Bay, and Tamarac; and uses
  250  Interstate 75 as portions of its southern border and the
  251  Loxahatchee National Wildlife Refuge as a portion of its eastern
  252  border, and
  253         WHEREAS, it is the intent of the Legislature to establish
  254  Congressional District 21, which is equal in population to other
  255  districts; is compact; includes portions of Broward and Palm
  256  Beach Counties; includes all of the municipalities of Coconut
  257  Creek, Coral Springs, Greenacres, Parkland, and Wellington; and
  258  uses the Loxahatchee National Wildlife Refuge as a portion of
  259  its western border, the Boca Raton, Delray Beach, Boynton Beach,
  260  Golf, and Palm Springs city lines for portions of its eastern
  261  border, the National Wildlife Refuge as a portion of its western
  262  border, and the Boca Raton, Delray Beach, Boynton Beach, Golf,
  263  and Palm Springs city lines for portions of its eastern border,
  264  and
  265         WHEREAS, it is the intent of the Legislature to establish
  266  Congressional District 22, which is equal in population to other
  267  districts; is compact; includes portions of Broward and Palm
  268  Beach Counties; includes all of the municipalities of Atlantis,
  269  Boca Raton, Briny Breezes, Delray Beach, Golf, Gulf Stream,
  270  Highland Beach, Hillsboro Beach, Hypoluxo, Lake Clarke Shores,
  271  Lauderdale-by-the-Sea, Lazy Lake, Lighthouse Point, Manalapan,
  272  Ocean Ridge, Palm Beach, Palm Springs, Sea Ranch Lakes, South
  273  Palm Beach, and Wilton Manors; and is traversed by Interstate 95
  274  and State Road A1A, and
  275         WHEREAS, it is the intent of the Legislature to establish
  276  Congressional District 23, which is equal in population to other
  277  districts; is compact; includes portions of Broward and Miami
  278  Dade Counties; includes all of the municipalities of Aventura,
  279  Bal Harbour, Bay Harbor Islands, Cooper City, Dania Beach,
  280  Davie, Golden Beach, Hallandale Beach, Hollywood, Indian Creek,
  281  Miami Beach, North Bay Villages, Southwest Ranches, Sunny Isles
  282  Beach, Surfside, and Weston; and uses Interstate 595 as portions
  283  of its northern border, and
  284         WHEREAS, it is the intent of the Legislature to establish
  285  Congressional District 24, which is equal in population to other
  286  districts; complies with Section 2 of the federal Voting Rights
  287  Act; does not deny or abridge the equal opportunity of racial or
  288  language minorities to participate in the political process or
  289  diminish their ability to elect representatives of their choice;
  290  ties urban neighborhoods of similar language, cultural, and
  291  socioeconomic characteristics in Miami-Dade and south Broward
  292  Counties; is compact; includes portions of Broward and Miami
  293  Dade Counties; includes all of the municipalities of Biscayne
  294  Park, El Portal, Miami Gardens, Miami Shores, North Miami, North
  295  Miami Beach, Opa-locka, Pembroke Park, and West Park; and is
  296  traversed by Interstate 95 and the Florida Turnpike, and
  297         WHEREAS, it is the intent of the Legislature to establish
  298  Congressional District 25, which is equal in population to other
  299  districts; complies with Sections 2 and 5 of the federal Voting
  300  Rights Act; does not deny or abridge the equal opportunity of
  301  racial or language minorities to participate in the political
  302  process or diminish their ability to elect representatives of
  303  their choice; ties communities of similar language, cultural,
  304  and socioeconomic characteristics; is compact; includes portions
  305  of Broward, Collier, Hendry, and Miami-Dade Counties; includes
  306  all of the municipalities of Doral, Everglades City, Hialeah
  307  Gardens, LaBelle, Medley, Miami Lakes, and Sweetwater; and uses
  308  the Tamiami Trail as a portion of its southern border and
  309  Interstate 75 as a portion of its northern border, and
  310         WHEREAS, it is the intent of the Legislature to establish
  311  Congressional District 26, which is equal in population to other
  312  districts; complies with Sections 2 and 5 of the federal Voting
  313  Rights Act; does not deny or abridge the equal opportunity of
  314  racial or language minorities to participate in the political
  315  process or diminish their ability to elect representatives of
  316  their choice; ties neighborhoods in western and south Miami-Dade
  317  and Monroe County of similar language, cultural, and
  318  socioeconomic characteristics; is compact; includes all of
  319  Monroe County and portions of Miami-Dade County; includes all of
  320  the municipalities of Florida City, Islamorada, Village of
  321  Islands, Key Colony Beach, Key West, Layton, and Marathon; and
  322  uses the Tamiami Trail as a portion of its northern border and
  323  U.S. 1 as a portion of its eastern border, and
  324         WHEREAS, it is the intent of the Legislature to establish
  325  Congressional District 27, which is equal in population to other
  326  districts; complies with Section 2 of the federal Voting Rights
  327  Act; does not deny or abridge the equal opportunity of racial or
  328  language minorities to participate in the political process or
  329  diminish their ability to elect representatives of their choice;
  330  ties neighborhoods of similar language, cultural, and
  331  socioeconomic characteristics; is compact; is wholly located in
  332  Miami-Dade County; includes all of the municipalities of Coral
  333  Gables, Cutler Bay, Key Biscayne, Miami Springs, Palmetto Bay,
  334  Pinecrest, South Miami, Virginia Gardens, and West Miami; and
  335  uses the Miami-Dade County line as a portion of its southern
  336  border and U.S. 1 as a portion of its western border, NOW,
  337  THEREFORE,
