       Senator Gibson moved the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Delete line 85
    4  and insert:
    5  incest, domestic violence, or human trafficking. A woman may
    6  waive the 24-hour waiting period if she lives 100 miles or more
    7  from the nearest abortion provider. If a woman has exercised her
    8  right to waive the state-mandated delay, the woman’s health care
    9  provider is not subject to any criminal, civil, or
   10  administrative penalty for failure to secure consent 24 hours in
   11  advance of the procedure. The patient’s signature noting that
   12  she has exercised her right to waive the 24-hour waiting period
   13  requirement is sufficient proof of the provider’s compliance
   14  with the requirements of this subparagraph. This subparagraph
   15  does not alter the health care provider’s duty to obtain
   16  voluntary and informed consent as otherwise required by this
   17  section.

   20  And the title is amended as follows:
   21         Delete line 5
   22  and insert:
   23         pregnancy; providing an exception; authorizing a woman
   24         to waive the 24-hour waiting period requirement under
   25         certain circumstances; providing that a health care
   26         provider is not subject to penalties under certain
   27         circumstances; providing for construction; reenacting
   28         s. 390.012(3)(d), F.S., relating
