    1         Senate Amendment (with title amendment)
    2  
    3         Delete everything after the enacting clause
    4  and insert:
    5         Section 1. Section 320.089, Florida Statutes, is amended to
    6  read:
    7         320.089 Veterans of the United States Armed Forces; members
    8  of National Guard; survivors of Pearl Harbor; Purple Heart medal
    9  recipients; active or retired United States Armed Forces
   10  reservists; Combat Infantry Badge, Combat Medical Badge, or
   11  Combat Action Badge recipients; Combat Action Ribbon recipients;
   12  Air Force Combat Action Medal recipients; Distinguished Flying
   13  Cross recipients; former prisoners of war; Korean War Veterans;
   14  Vietnam War Veterans; Operation Desert Shield Veterans;
   15  Operation Desert Storm Veterans; Operation Enduring Freedom
   16  Veterans; and Operation Iraqi Freedom Veterans; Women Veterans;
   17  World War II Veterans; and Navy Submariners; special license
   18  plates; fee.—
   19         (1)(a) Each owner or lessee of an automobile or truck for
   20  private use or recreational vehicle as specified in s.
   21  320.08(9)(c) or (d), which is not used for hire or commercial
   22  use, who is a resident of the state and a veteran of the United
   23  States Armed Forces, a Woman Veteran, a World War II Veteran, a
   24  Navy Submariner, an active or retired member of the Florida
   25  National Guard, a survivor of the attack on Pearl Harbor, a
   26  recipient of the Purple Heart medal, an active or retired member
   27  of any branch of the United States Armed Forces Reserve, or a
   28  recipient of the Combat Infantry Badge, Combat Medical Badge, or
   29  Combat Action Badge, Combat Action Ribbon, Air Force Combat
   30  Action Medal, or Distinguished Flying Cross shall, upon
   31  application to the department, accompanied by proof of release
   32  or discharge from any branch of the United States Armed Forces,
   33  proof of active membership or retired status in the Florida
   34  National Guard, proof of membership in the Pearl Harbor
   35  Survivors Association or proof of active military duty in Pearl
   36  Harbor on December 7, 1941, proof of being a Purple Heart medal
   37  recipient, proof of active or retired membership in any branch
   38  of the United States Armed Forces Reserve, or proof of
   39  membership in the Combat Infantrymen’s Association, Inc., or
   40  other proof of being a recipient of the Combat Infantry Badge,
   41  Combat Medical Badge, or Combat Action Badge, Combat Action
   42  Ribbon, Air Force Combat Action Medal, or Distinguished Flying
   43  Cross, and upon payment of the license tax for the vehicle as
   44  provided in s. 320.08, shall be issued a license plate as
   45  provided by s. 320.06, upon which, in lieu of the serial numbers
   46  prescribed by s. 320.06, is shall be stamped with the words
   47  “Veteran,” “Woman Veteran,” “WWII Veteran,” “Navy Submariner,”
   48  “National Guard,” “Pearl Harbor Survivor,” “Combat-wounded
   49  veteran,” “U.S. Reserve,” “Combat Infantry Badge,” “Combat
   50  Medical Badge,” or “Combat Action Badge,” “Combat Action
   51  Ribbon,” “Air Force Combat Action Medal,” or “Distinguished
   52  Flying Cross,” as appropriate, and a likeness of the related
   53  campaign medal or badge, followed by the serial number of the
   54  license plate. Additionally, the Purple Heart plate may have the
   55  words “Purple Heart” stamped on the plate and the likeness of
   56  the Purple Heart medal appearing on the plate.
   57         (b) Notwithstanding any other provision of law to the
   58  contrary, beginning with fiscal year 2002-2003 and annually
   59  thereafter, the first $100,000 in general revenue generated from
   60  the sale of license plates issued under this section shall be
   61  deposited into the Grants and Donations Trust Fund, as described
   62  in s. 296.38(2), to be used for the purposes established by law
   63  for that trust fund. Any additional general revenue generated
   64  from the sale of such plates shall be deposited into the State
   65  Homes for Veterans Trust Fund and used solely to construct,
   66  operate, and maintain domiciliary and nursing homes for
   67  veterans, subject to the requirements of chapter 216.
   68         (c) Any revenue generated from the sale of Woman Veteran
   69  license plates must be deposited into the Operations and
   70  Maintenance Trust Fund administered by the Department of
   71  Veterans’ Affairs pursuant to s. 20.375(3) and must be used
   72  solely for the purpose of creating and implementing programs to
   73  benefit women veterans. Notwithstanding any provisions of law to
   74  the contrary, an applicant for a Pearl Harbor Survivor license
   75  plate or a Purple Heart license plate who also qualifies for a
   76  disabled veteran’s license plate under s. 320.084 shall be
   77  issued the appropriate special license plate without payment of
   78  the license tax imposed by s. 320.08.
   79         (2) Each owner or lessee of an automobile or truck for
   80  private use, a truck weighing not more than 7,999 pounds, or a
   81  recreational vehicle as specified in s. 320.08(9)(c) or (d),
   82  which is not used for hire or commercial use, who is a resident
   83  of this the state and who is a former prisoner of war, or his or
   84  her their unremarried surviving spouse, shall, upon application
   85  therefor to the department, shall be issued a license plate as
   86  provided in s. 320.06, on which license plate are stamped with
   87  the words “Ex-POW” followed by the serial number. Each
   88  application shall be accompanied by proof that the applicant
   89  meets the qualifications specified in paragraph (a) or paragraph
   90  (b).
   91         (a) A citizen of the United States who served as a member
   92  of the Armed Forces of the United States or the armed forces of
   93  a nation allied with the United States who was held as a
   94  prisoner of war at such time as the Armed Forces of the United
   95  States were engaged in combat, or his or her their unremarried
   96  surviving spouse, may be issued the special license plate
   97  provided for in this subsection without payment of the license
   98  tax imposed by s. 320.08.
   99         (b) A person who was serving as a civilian with the consent
  100  of the United States Government, or a person who was a member of
  101  the Armed Forces of the United States while he or she who was
  102  not a United States citizen and was held as a prisoner of war
  103  when the Armed Forces of the United States were engaged in
  104  combat, or his or her their unremarried surviving spouse, may be
  105  issued the special license plate provided for in this subsection
  106  upon payment of the license tax imposed by s. 320.08.
  107         (3) Each owner or lessee of an automobile or truck for
  108  private use, a truck weighing not more than 7,999 pounds, or a
  109  recreational vehicle as specified in s. 320.08(9)(c) or (d),
  110  which is not used for hire or commercial use, who is a resident
  111  of this state and who is the unremarried surviving spouse of a
  112  recipient of the Purple Heart medal shall, upon application
  113  therefor to the department accompanied by, with the payment of
  114  the required fees, shall be issued a license plate as provided
  115  in s. 320.06, on which is license plate are stamped with the
  116  words “Purple Heart” and the likeness of the Purple Heart medal
  117  followed by the serial number. Each application shall be
  118  accompanied by proof that the applicant is the unremarried
  119  surviving spouse of a recipient of the Purple Heart medal.
  120         (4) The owner or lessee of an automobile or truck for
  121  private use, a truck weighing not more than 7,999 pounds, or a
  122  recreational vehicle as specified in s. 320.08(9)(c) or (d)
  123  which automobile, truck, or recreational vehicle is not used for
  124  hire or commercial use, who is a resident of this the state and
  125  a current or former member of the United States Armed Forces,
  126  and who was deployed and served in Korea during the Korean War
  127  as defined in s. 1.01(14), shall, upon application to the
  128  department, accompanied by proof of active membership or former
  129  active duty status during the Korean War, and upon payment of
  130  the license tax for the vehicle as provided in s. 320.08, shall
  131  be issued a license plate as provided by s. 320.06 upon which,
  132  in lieu of the registration license number prescribed by s.
  133  320.06, is shall be stamped with the words “Korean War Veteran,”
  134  and a likeness of the Korean Service Medal, followed by the
  135  registration license number of the plate. Proof that the
  136  applicant was awarded the Korean Service Medal is sufficient to
  137  establish eligibility for the license plate.
  138         (5) The owner or lessee of an automobile or truck for
  139  private use, a truck weighing not more than 7,999 pounds, or a
  140  recreational vehicle as specified in s. 320.08(9)(c) or (d)
  141  which automobile, truck, or recreational vehicle is not used for
  142  hire or commercial use, who is a resident of this the state and
  143  a current or former member of the United States military, and
  144  who was deployed and served in Vietnam during United States
  145  military deployment in Indochina shall, upon application to the
  146  department, accompanied by proof of active membership or former
  147  active duty status during these operations, and, upon payment of
  148  the license tax for the vehicle as provided in s. 320.08, shall
  149  be issued a license plate as provided by s. 320.06 upon which,
  150  in lieu of the registration license number prescribed by s.
  151  320.06, is shall be stamped with the words “Vietnam War
  152  Veteran,” and a likeness of the Vietnam Service Medal, followed
  153  by the registration license number of the plate. Proof that the
  154  applicant was awarded the Vietnam Service Medal is sufficient to
  155  establish eligibility for the license plate.
  156         (6) The owner or lessee of an automobile or truck for
  157  private use, a truck weighing not more than 7,999 pounds, or a
  158  recreational vehicle as specified in s. 320.08(9)(c) or (d)
  159  which automobile, truck, or recreational vehicle is not used for
  160  hire or commercial use who is a resident of this the state and a
  161  current or former member of the United States military who was
  162  deployed and served in Saudi Arabia, Kuwait, or another area of
  163  the Persian Gulf during Operation Desert Shield or Operation
  164  Desert Storm; in Afghanistan during Operation Enduring Freedom;
  165  or in Iraq during Operation Iraqi Freedom shall, upon
  166  application to the department, accompanied by proof of active
  167  membership or former active duty status during one of these
  168  operations, and upon payment of the license tax for the vehicle
  169  as provided in s. 320.08, shall be issued a license plate as
  170  provided by s. 320.06 upon which, in lieu of the registration
  171  license number prescribed by s. 320.06, is shall be stamped with
  172  the words “Operation Desert Shield,” “Operation Desert Storm,”
  173  “Operation Enduring Freedom,” or “Operation Iraqi Freedom,” as
  174  appropriate, and a likeness of the related campaign medal
  175  followed by the registration license number of the plate. Proof
  176  that the applicant was awarded the Southwest Asia Service Medal,
  177  Iraq Campaign Medal, Afghanistan Campaign Medal, or Global War
  178  on Terrorism Expeditionary Medal is sufficient to establish
  179  eligibility for the appropriate license plate.
  180         Section 2. This act shall take effect July 1, 2015.

  189         Safety and Motor Vehicles to issue Woman Veteran,
  190         World War II Veteran, Navy Submariner, Combat Action
  191         Ribbon, Air Force Combat Action Medal, and
  192         Distinguished Flying Cross license plates; specifying
  193         qualifications and requirements for the plates;
  194         requiring that any revenue generated from the sale of
  195         Woman Veteran license plates be deposited into the
  196         Operations and Maintenance Trust Fund to be used for
  197         certain purposes; providing an effective date.
